Every person who contravenes this provision is guilty of an offence and is liable to a fine (ss. 11.2, 11.2.1 and 135 Y.P.A .). [ 1 ] The Director of Youth Protection of A submits an application for review under ss. 95(1) and 91 of the Youth Protection Act . [ 2 ] On behalf of the mother, her counsel admits some of the allegations in the application. She is not aware of part of her son’s situation. However, she agrees with the recommendations submitted by the applicant. [ 3 ] The youth admits all the allegations in the application and also agrees to all the recommendations.
ANALYSIS OF THE SITUATION AND DECISION [ 4 ] Since the last Court order, X was entrusted to the Group Home of A. After a period spent adapting to this structured environment, he has adjusted well to the unit. [ 5 ] He no longer has suicidal ideations. He took some medication to help him with his depression. The treatment helps him stabilize his mood. [ 6 ] On April 25, 2018, he ran away from the unit. Actually, he did not return to the unit after leaving work. He returned later the same night. He admits to having smoked cannabis while away.
According to the revision report, he discussed the event with the worker and confirmed it would not happen again. [ 7 ] X has improved since being entrusted to the group home. He has a full-time job at Family and Social Services B. The plan for the next month is to prepare and support him in his transition to adulthood.
He will turn 18 on […], 2018. [ 8 ] The applicant, Mr. [social worker 2], explained to the Court how he will be supported and referred to services for adults in order to be sure he receives services and training after he reaches the age of majority. [ 9 ] The mother is prepared to support her son in this major transition.
One possibility is that he moves in with her in Town A and begins to work at [Company A]. [ 10 ] In upcoming months, he will work on a realistic plan to ensure his autonomy, and he will be supported by the staff of the group home and by the applicant. [ 11 ] The Court is of the opinion that it is in the best interests of the youth to follow the recommendations. CONSEQUENTLY AND FOR THESE REASONS, THE COURT: [ 12 ] GRANTS the application;
[ 13 ] REVISES AND EXTENDS the decision or order rendered on November 21, 2017; [ 14 ] DECLARES that the security or development of X, born on […], 2000, continues to be in danger; [ 15 ] ORDERS that the youth be entrusted to an institution operating a rehabilitation centre chosen by the institution operating a child and youth protection centre; [ 16 ] ORDERS that the youth and the youth’s parents take an active
part in the application of the measures ordered by the Court; [ 17 ] RECOMMENDS that the parents seek help for their personal issues through social services ; [ 18 ] ORDERS that a person working for an institution or body provides aid, counselling or assistance to the youth and the youth’s family; [ 19 ] ORDERS the police to collaborate with the execution of the enactment; [ 20 ] ENTRUSTS the situation of the youth to the Director of Youth Protection of A for the purpose of executing the order; [ 21 ] THE WHOLE until the age of majority of the youth on […], 2018. __________________________________ RENÉE LEMOINE, J.C.Q.
