Royal Dubue Defendant ______________________________________________________________________ JUDGMENT ______________________________________________________________________ [ 1 ] Given the agreement between the parties dated December 10, 2013 which reads as follows: « Whereas the parties wish to settle the present case according to the present agreement; The parties agree on what follows: 1. The defendant accepts that a judgment be rendered in the Court file for the amount of 21 657,66 $; 2.
The plaintiff agrees, if the defendant is not in default according to the present agreement, to accept as full payment the amount of 15 000 $ payable by monthly instalments of 500 $ a month starting on January 1 st , 2014 by post dated cheques; 3. In the event of the transfer of the house situated at C3 Estate Road in Sand Bay to any third party, the balance of the amount owed will be paid immediately; 4. The defendant will be in default if any one of the following events occurs:
a) a monthly instalment of 500 $ is not paid on the first day of the month
b) one of the checks bounces back If any of these events occur, the full amount mentioned at paragraph 1 of the present agreement will be paid after subtracting the amounts already paid. 5. The parties agree that the judge homologates the present agreement and transaction; 6. There will be no interest on the amounts to be paid; 7. Each party paying their costs.
