He subsequently appealed those convictions on grounds that involve questions of law. [ 2 ] He now seeks leave to appeal the convictions on grounds that involve questions of fact. [ 3 ] Crown counsel has suggested that the motion for leave to appeal be referred to the panel of this Court that will hear the appeal on its merits. Counsel for the appellant agrees with this suggestion.
