Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d’identifier un enfant ou ses parents.
Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.p.j.). [ 1 ] Le Tribunal est saisi d'une requête en révision et prolongation de l'ordonnance rendue le 30 mars 2014 dans laquelle il confiait l'adolescent à sa mère et ordonnait certaines autres mesures visant à corriger la situation. [ 2 ] La requérante, la Directrice de la protection de la jeunesse (DPJ), allègue que depuis le prononcé de cette ordonnance, des faits nouveaux sont survenus et exigent une révision de l'ordonnance prononcée et ce, pour des motifs liés aux besoins de l'adolescent et à la capacité de la mère à y répondre. [ 3 ] En conséquence, la requérante recommande au Tribunal d'ordonner l'hébergement de l'adolescent en centre de réadaptation pour une période de trois mois et d'autoriser sa réintégration dans le milieu familial dès que la situation le permettra. [ 4 ] La requérante recommande aussi un suivi social pour une période d'une année. [ 5 ] La mère admet l'essentiel des faits allégués dans la requête et exprime son accord avec les recommandations. [ 6 ] Après avoir entendu l'ensemble de la preuve et la position de la mère, l'adolescent, par le biais de son procureur, fait une admission de tous les faits allégués à la requête et exprime son accord avec les recommandations. [ 7 ] Tenant compte des admissions formulées par la mère, l'adolescent et la preuve documentaire, le Tribunal conclut que la situation de l'adolescent exige une révision et une prolongation d'ordonnance pour les motifs allégués. [ 8 ] Le Tribunal retient les éléments suivants : [ 9 ] The adolescent's behaviour stabilized until the end of the summer. [ 10 ] The adolescent participated with the "Big Brother" Program. [ 11 ] At school, improvements were noticed in the adolescent's behaviour. [ 12 ] Since September 2014, the adolescent's behavioural disturbances resurfaced at home, more particularly but not restrictively in that: - The adolescent has not been respecting his mother's house rules; - The adolescent has been displaying temper tantrums; - The adolescent has been physically aggressive with his mother;
- On a few occasions, the adolescent has thrown objects at his mother. [ 13 ] The adolescent has not been collaborating with his educator. [ 14 ] The adolescent has not participated in his psychiatric follow-up but he resumed since he was placed the 17th of December 2014. [ 15 ] On December 15, 2014, the mother expressed that she was overwhelmed with the situation and asked for the adolescent to be placed. [ 16 ] Immediate protective measures were invoked and the adolescent was placed in a rehabilitation centre.
Mesures [ 17 ] Dans un rapport déposé sous la cote D-1, [intervenante 1], personne autorisée par la DPJ, analyse ainsi les besoins de l'adolescent et les capacités de la mère à y répondre : "X and Ms. B have a problematic communication style which often leads to crisis. X does not respect his mother's authority and does not following the rules and consequences. Ms. B has very little control of the situation and is overwhelmed dealing with his behavior. X has not engaged in his psychiatric follow up appointments.
Continuous educator and group home support is still needed to help the situation between X and his mother. As well, to provide X with the structure and tools needed to self regulate and subsequently express his needs and frustrations more appropriately.
It is imperative that X follows the psychiatric treatment plan. [1] " [ 18 ] L'intervenante sociale identifie le but et les objectifs visés par le plan d'intervention dans les termes suivants : - That the mother and the adolescent work with an educator to continue to address parenting issues and communication between them; - That X continue to develop and be encouraged to work on verbal communication; - Encourage mother to develop her social support by meeting with friends and people; - That mother also participate in individual counseling [2] . [ 19 ] TENANT COMPTE du consentement exprimé par la mère et l'adolescent; [ 20 ] TENANT COMPTE du fait que l'adolescent a repris son suivi psychiatrique depuis le 17 décembre 2014 et qu'il a l'intention de le maintenir; [ 21 ] LE TRIBUNAL : [ 22 ] CONCLUT que les recommandations de la requérante sont dans l'intérêt de l'enfant; [ 23 ] THEREFORE, [ 24 ] GRANTS the motion; [ 25 ] REVISES and EXTENDS the decision rendered on March 30, 2014; [ 26 ] DECLARES that the security and development of the adolescent are still in danger; [ 27 ] ORDERS that the adolescent remain in a rehabilitation center for a period of 3 months and AUTHORIZES the reintegration in his mother's care as soon as the situation allows; [ 28 ] ORDERS that the mother follow through with the recommendations of the adolescent's treating team at A Hospital, with regard to her own individual therapy; [ 29 ] ORDERS that the mother and the adolescent collaborate with his treatment at A Hospital, namely taking his medication as instructed, attending his appointments and actively participate in his appointments; [ 30 ] ORDERS that a person working for a Child and Youth Protection Centre provide aid, counsel and assistance to the adolescent and his family for a period of one year; [ 31 ] ENTRUSTS the situation of the adolescent, X, to the Director of Youth Protection of A Youth and Family Centres, who shall then see that the measures are carried out; __________________________________ LUCIE GODIN, J.C.Q.
