Partie demanderesse, Hinda Abdelkrim ( Abdelkrim ) réclame de la
Partie défenderesse, APP Group (Canada) Inc. ( APP ) 15 000 $ en dommages alléguant renvoi injustifié. [ 2 ] La réclamation originale de la demanderesse Abdelkrim était de 93 333,33 $ qui fut réduite volontairement à 15 000 $ aux fins qu’elle soit admissible à la Division des petites créances. [ 3 ] Abdelkrim soutient avoir été renvoyée de façon abusive et sans justification de son emploi auprès de APP d’où la poursuite de 15 000 $. [ 4 ] Tel qu’il appert d’un Contrat intervenu entre les parties le 19 août 2019, APP qui œuvre dans le domaine du design, distribution et vente des manteaux et autres accessoires, a engagé Abdelkrim pour un terme indéterminé en tant que « Senior Fit Technician ».
Celle- ci devait se rapporter directement à la vice-présidente de production et ressources. [ 5 ] Les termes pertinents du Contrat [1] sont reproduits ici pour une meilleure compréhension du litige. 2. Probationary Period The employment of the Employee shall include a probationary period of three (3) months . During this time, the Employee’s performance and suitability shall be monitored and evaluated by the Company.
If the Company concludes that the Employee is not suitable for the employment offered, or unable to properly carry out any of her duties, the Company shall have the right to terminate the Employee’s employment at any time during the said probationary period. 3. Salary, Bonus and Benefits 3.1 Base Salary . As of the State Date, the Employee shall be paid a gross annual salary of SEVENTY THOUSAND dollars ( 70,000.00 ) (the “ Base Salary ”).
The Base Salary shall be paid in accordance with the Company’s regular payroll practices and be subject to the statutory withholdings required in virtue of the applicable statutory provisions. The Employee shall be paid every two (2) weeks, in arrears, by direct bank transfer. Subject to the following, the Employee agrees and recognizes that the above Base Salary shall be inclusive of all aspects of her work performed to the benefit of the Company. 9. Termination
9.1 The parties understand and agree that the Employee’s employment pursuant to this Agreement may terminate at any time, by the Company, in its absolute discretion for serious reasons. 9.2 In the event of Employee’s termination for any reason, the Employee’s shall be entitled to receive: earned but unpaid Base Salary and benefits through the termination date; (ii) reimbursement of expenses incurred through the termination date; (iii) pay-out for accrued but unused vacation days. 9.3 Except where serious reason exists and subject to the previsions of
Article 2.1, the parties understand and agree that the Company, in its absolute discretion and for any reason whatsoever, may terminate the Employee’s employment by
a) providing a written prior notice of cessation of employment of one (1) week of the Employee has been employed by the Company for more than 3 months but for less than a year (after more than twelve (12) months of continuous employment, the notice will be of two (2) weeks; or
b) paying to the Employee an indemnity equivalent to one (1) week of the Employee’s Salary in lieu of the prior notice referred to in paragraph (
a) above. After more than twelve (12) months of continuous employment, the indemnity will be equivalent to two (2) weeks) Salary. […] 9.5 This Agreement shall be terminated upon expiration of a two (2) week written notice to this effect given by the Employee.
The Employee agree and recognizes that the notice period provided for in the present paragraph shall be for the sole benefit of the Company and that, as such, the Company, in its sole discretion, shall have the right to renounce and waive the benefit of part and/or the totality of any such notice, in which case the Employee’s employment with the Company shall cease as of the date determined by the Company and the Employee shall cease to receive her usual Salary as of such date. [Reproduction partielle] [ 6 ] Une mise en demeure fut adressée le 3 mars 2020 [2] , réclamant des dommages avec la mention suivante : “Given the foregoing, including our client’s current age of 52 years, her Expertise, the Harassment Complaint, the overall Compensation as witnessed by the Employment Agreement and the Abusive Breach as contextualised by the foregoing, we demand, on our Client’s behalf, that : (
i) a bonified offer of sixteen (16) months of Gross Salary (the “ Bonified Offer ”) be paid to the undesigned in trust in consideration of the APP Group release and discharge hand remitted to our client February 18 th , 2020 being fully executed by our Client, or (ii) a modified Offer being negotiated with the undesigned to the satisfaction of both parties, no longer that Wednesday March 11 th , 2020 at 12:00 PM (noon) ( collectively, the “Counter-Offer” )”. [Reproduction partielle] [ 7 ] APP représentée par Monsieur Alain Thiffault, responsable des ressources humaines conteste la réclamation. [ 8 ] Celle-ci admet qu’effectivement Abdelkrim fut engagée le ou vers le 19 août 2019, en tant que « Senior Fit Technician » soit « Technicienne en ajustement » selon les termes du Contrat [3] . [ 9 ] Un avis « Termination of employment » fut adressé le 28 février 2020, résiliant ce contrat d’emploi [4] . [ 10 ] Selon les articles 82 et 83 de la
Loi sur les normes du travail, la demanderesse devait recevoir un avis d’une semaine ou indemnité équivalente. [ 11 ] Selon les termes de la lettre de terminaison Abdelkrim fut effectivement offert un paiement de huit jours totalisant 2 154,24 $, c’est-à-dire une semaine et demie. [ 12 ] Aucune réponse ne fut adressée par la demanderesse Abdelkrim à cet égard.
[ 13 ] Décision fut prise, par après de lui remettre tel que dû, cinq jours en vertu de l’article 9.3a du Contrat d’emploi [5] de même que l’article 92 de la
Loi sur les normes du travail [6] . [ 14 ] Selon le témoignage de M. Thiffault il y eut plusieurs problématiques concernant le comportement de Abdelkrim, soit avec les autres employés, refus de recevoir les instructions de sa supérieure, manque de collaboration, problème d’adaptation en n’acceptant pas les critiques, de même que des accusations non fondées de discrimination et harcèlement psychologique. Celui-ci ajoute que APP a à son emploi plusieurs ethnicités soit près d’une centaine ce qui fait sa force et sa fierté. De plus, elle fait affaires internationalement dans de nombreux pays.
Ceci explique pourquoi des accusations de discriminations sont prises au sérieux avec un code d’éthique qui s’applique à tous. CONSIDÉRANT que les termes du Contrat d’emploi [7] furent respectés par la
partie défenderesse, son employeur, APP. CONSIDÉRANT que les accusations que Abdelkrim a adressées contre APP pour discriminations auprès de la CNESST et harcèlement psychologique furent rejetées, tel qu’il appert d’un avis du 18 novembre 2020 par la plume de Janick Beaudoin, Responsable du dossier; « Référence : Dossier no 620089421 – Normes du travail La salariée : MADAME HINDA ABDELKRIM Objet : Fermeture du dossier L’enquête réalisée à la suite de la plainte pour harcèlement psychologique déposée en vertu de la
Loi sur les normes du travail par la salariée mentionnée en
titre amène la Commission à mettre fin à son intervention dans le traitement de cette plainte. » [Reproduction partielle] CONSIDÉRANT que la
partie demanderesse n’a pas rencontré son fardeau de preuve en vertu de la loi; CONSIDÉRANT les articles 2803, 2804 et 2845 du Code civil du Québec . 2803. Celui qui veut faire valoir un droit doit prouver les faits qui soutiennent sa prétention. Celui qui prétend qu’un droit est nul, a été modifié ou est éteint doit prouver les faits sur lesquels sa prétention est fondée. 2804. La preuve qui rend l’existence d’un fait plus probable que son inexistence est suffisante, à moins que la loi n’exige une preuve plus convaincante. 2845. La force probante du témoignage est laissée à l’appréciation du tribunal. PAR CES MOTIFS, LE TRIBUNAL :
REJETTE la Demande de la
Partie demanderesse, Hinda Abdelkrim contre la
