Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). ______________________________________________________________________ [ 1 ] The Director of Youth Protection submits to the Court an Application to declare the security and the development of the child compromised concerning the child; [ 2 ] On June 23, 2020, the parties submitted to the Court a draft agreement, as provided for in
section 76.3 of the Youth Protection Act, which is annexed to this judgment and forms an integral part of it; [ 3 ] The parties agree that the security and development of the child are compromised under
section 38
c) of the Youth Protection Act and agree on the measures to be taken to remedy the situation of compromise. [ 4 ] This agreement, which reflects the position expressed by the parties, respects the prescriptions of the Youth Protection Act and responds to the best interest of the child and the respect of his rights; [ 5 ] It is therefore necessary to ratify this agreement and make it enforceable. THEREFORE, THE COURT: [ 6 ] GRANTS the Application; [ 7 ] DECLARES that the security and the development of the child are compromised under 38
c) of the Youth Protection Act;
[ 8 ] RATIFIES AND DECLARES EXECUTORY the agreement between the parties attached to the present judgment; [ 9 ] ENTRUSTS the situation of the child, X, to the Director of Youth Protection for the execution of the measures. [ 10 ] THE WHOLE for a period of one (1) year.
