Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d’identifier un enfant ou ses parents. Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). [ 1 ] Invoquant une situation de troubles de comportement sérieux et de négligence sur le plan éducatif, la Directrice de la protection de la jeunesse demande au Tribunal de déclarer compromis la sécurité et le développement de X, âgée de 12 ans. À
titre de mesures, elle recommande l’hébergement de l’adolescente en famille d’accueil pendant neuf mois, avec réintégration progressive chez la mère si la situation le permet, et un suivi social d’un an. [ 2 ] La mère reconnaît l’existence de la situation de compromission et consent aux mesures suggérées. Le père, qui vit dans le nord du Québec, est absent. L’intervenante sociale a réussi à le contacter et a eu de ses nouvelles, pour la dernière fois, le 7 février 2017.
Le père, par courriel, la prévenait alors qu’il ne pouvait prendre charge de sa fille et il proposait que cette dernière soit confiée à une tante. [ 3 ] Quant à l’adolescente, elle admet avoir des troubles de comportement sérieux et aimerait retourner chez sa mère. Toutefois, comme celle-ci n’y consent pas, elle demande de réduire à trois mois la durée de l’hébergement.
Elle ne veut cependant pas quitter la région pour aller demeurer chez sa tante. [ 4 ] Seule la durée de la période d’hébergement est donc en litige. [ 5 ] La preuve révèle en effet que l’adolescente a des troubles de comportement sérieux et que la mère a de grandes difficultés à contrôler sa fille. [ 6 ] En février 2016, la mère conduit en effet sa fille dans les bureaux de la Directrice de la protection de la jeunesse car elle n’est plus capable de l’encadrer et d’obtenir son respect.
Après un séjour de moins de 24 heures en famille d’accueil, X retourne cependant chez sa mère. [ 7 ] Reconnaissant l’existence de situations de négligence, de mauvais traitements psychologiques et de troubles de comportement, les parties signent une entente sur mesures volontaires le 26 juillet 2016 : X est alors maintenue auprès de sa mère et elle s’engage à fréquenter l’école. D’une durée de neuf mois, ces mesures devaient se terminer le 24 avril 2017. [ 8 ] À partir du mois de septembre 2016, toutefois, X s’absente de plus en plus fréquemment de l’école.
En décembre, elle n’assiste à ses cours que durant deux jours. De plus, l’adolescente consomme et commet quelques infractions. [ 9 ] Enfin, le 3 janvier 2017, X se dispute violemment avec son frère; les policiers doivent intervenir pour la calmer.
[ 10 ] À la suite de ce conflit, la Directrice de la protection de la jeunesse retire X de son milieu familial; l’adolescente passe 24 heures en centre de réadaptation et, le 6 janvier, le Tribunal la confie à une famille d’accueil pour une période de cinq jours ouvrables. Le 13 janvier 2017, le juge Sylvain Meunier ordonne son hébergement provisoire en famille d’accueil jusqu’au 3 mars 2017. Depuis, X se comporte mieux. Elle ne s’absente plus de l’école. [ 11 ] Selon la preuve prépondérante, la mère est incapable d’affirmer son autorité auprès de sa fille.
Il faut dire qu’elle étudie et est fréquemment absente de la maison. [ 12 ] La preuve permet donc de conclure que la sécurité et que le développement de l’adolescente sont compromis en raison de situations de négligence sur le plan éducatif et de troubles sérieux de comportement. [ 13 ] Par ailleurs, il est dans l’intérêt de l’adolescente qu’elle demeure en famille d’accueil durant neuf mois, ce qui lui permettra d’amorcer la rentrée scolaire de septembre 2017 dans son milieu d’accueil. [ 14 ] De plus, une telle période permettra à la mère de perfectionner ses habiletés parentales et à x d’améliorer sa capacité à gérer ses émotions.
La prochaine réinté-gration de l’adolescente dans son milieu familial maternel doit, en effet, être un succès. [ 15 ] Dans ces circonstances, le Tribunal n'a aucune hésitation à déclarer la sécurité et le développement de l’adolescente compromis et à faire droit aux mesures de protection suggérées qui, selon la preuve, sont appropriées à ses besoins. [ 16 ] La demande est fondée; elle est dans l’intérêt de l'adolescente et respecte ses droits. [ 17 ] POUR CES MOTIFS, LE TRIBUNAL : [ 18 ] ACCUEILLE la demande; [ 19 ] DÉCLARE la sécurité et le développement de l'adolescente compromis; [ 20 ] ORDONNE l’exécution des mesures de protection suivantes :
a) Que l’adolescente soit confiée à une famille d’accueil pour une durée de neuf mois;
b) Qu’ une personne qui travaille pour un établissement ou un organisme CISSA/CJA apporte aide, conseils ou assistance à l’adolescente et à sa famille pour la période de douze mois;
c) Que la fréquence et la durée des contacts entre l’adolescente et ses parents soient déterminées selon entente entre les parties; tout différend à cet égard devant être soumis au Tribunal;
d) Que l’adolescente fréquente un établissement scolaire de façon assidue;
e) That the adolescent and her parents participate actively in the elaboration and revision of their family’s intervention plan and that they respect it in order to put an end to the compromising situation; [ 21 ] RECOMMENDs :
a) That the adolescent receive all the services required for her situation (psychological follow-up, help to learn how to deal appropriately with her emotions, help with her identity issues) and respect the recommendations;
b) That the mother receive the care required (parenting abilities) to help her put an end to the compromising situation and respect the recommendations; [ 22 ] PREND ACTE de l'intention de la Directrice de la protection de la jeunesse de se prévaloir, si la situation le permet, des moyens prévus à l'article 62 de la

Every person who contravenes this provision is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [1] Invoking a situation of serious behavioural disturbances and of neglect from the standpoint of schooling, the Director of Youth Protection asked the Court to declare that the security and development of X, 12 years old, are in danger.
As measures, the Director recommended that the adolescent be placed in a foster family for nine months, with a gradual return to the mother’s home if the situation allowed, as well as social follow-up for one year. [2] The mother acknowledged the existence of the situation of endangerment and consented to the measures recommended. The father, who lives in Northern Québec, was absent. The social worker was able to contact him and heard from him for the last time on February 7, 2017.
In an email, the father told the social worker that he was unable to take care of his daughter and proposed that she be entrusted to an aunt. [3] The adolescent admitted having serious behavioural disturbances and would like to return to her mother’s home. However, as the mother did not agree to it, the adolescent asked that the placement period be reduced to three months.
However, she did not want to leave the area to go live with her aunt. [4] Hence, only the placement period is in dispute. [5] The evidence shows that the adolescent does have serious behavioural disturbances and that the mother has great difficulty controlling her daughter. [6] In February 2016, the mother took her daughter to the offices of the Director of Youth Protection, as she was no longer able to supervise her and get her respect.
But after a 24-hour stay in a foster family, X returned to her mother’s home. [7] Acknowledging the existence of situations of neglect, psychological ill-treatment and behavioural disturbances, the parties signed an agreement on voluntary measures on July 26, 2016. X was then kept with her mother and she undertook to attend school. The nine-month measures were scheduled to end on April 24, 2017. [8] However, as of September 2016, X missed school more and more often. In December, she attended classes for only two days. In addition, the adolescent abused substances and committed a few offences.
[9] Lastly, on January 3, 2017, X had a violent argument with her brother; the police had to intervene to calm her down. [10] Further to that conflict, the Director of Youth Protection removed X from her family environment; the adolescent spent 24 hours in a rehabilitation centre and, on January 6, the Court entrusted her to a foster family for a period of five working days. On January 13, 2017, Sylvain Meunier J. ordered her provisional placement in a foster family until March 3, 2017. Since then, X’s behaviour has improved.
She no longer misses school. [11] According to the preponderant evidence, the mother is unable to assert her authority over her daughter.
It must be said that she studies and is often away from home. [12] Hence, the evidence makes it possible to conclude that the security and development of the adolescent are in danger because of situations of neglect from the standpoint of schooling and of serious behavioural disturbances. [13] Furthermore, it is in the adolescent’s interest that she remain with a foster family for a period of nine months, which will allow her to begin the school year in September 2017 in her foster environment. [14] In addition, such a period of time will allow the mother to improve her parenting skills and X her ability to manage her emotions.
The adolescent’s next return to her mother’s environment must in fact be successful. [15] In the circumstances, the Court has no hesitation in declaring that the adoles-cent’s security and development are in danger and in allowing the recommended pro-tective measures, which, according to the evidence, are suited to the adolescent’s needs. [16] The application is founded; it is in the adolescent’s interest and in keeping with her rights. [17] THEREFORE, THE COURT : [18] ALLOWS the application; [19] DECLARES that the adolescent’s security and development are in danger; [20] ORDERS the execution of the following protective measures:
f) That the adolescent be entrusted to a foster family for nine months;
g) That a person working for an institution or CISSA/CJA body provide aid, counselling or assistance to the adolescent and her family for 12 months;
h) That the frequency and duration of contact between the adolescent and her parents be determined by agreement between the parties, with any dispute in that regard being submitted to the Court;
i) That the adolescent attend school assiduously;
j) That the adolescent and her parents participate actively in the elaboration and revision of their family’s intervention plan and that they respect it in order to put an end to the compromising situation; [21] RECOMMENDs:
c) That the adolescent receive all the services required for her situation (psychological follow-up, help to learn how to deal appropriately with her emotions, help with her identity issues) and respect the recommendations;
d) That the mother receive the care required (parenting abilities) to help her put an end to the compromising situation and respect the recommendations; [22] ACKNOWLEDGES the intention of the Director of Youth Protection to avail herself, if the situation so warrants, of the means provided for in
section 62 of the Youth Protection Act in order to allow the adolescent’s gradual return to her mother’s environment, in the last two months of the placement measure; [23] ENTRUSTS the situation of the adolescent to the Director of Youth Protection for the execution of this decision. __________________________________ MARIE PRATTE J.C.Q.
