KATDOR APARTMENTS INC. and STEVE CARSON […] Pointe-Claire, Qc […] Defendants ______________________________________________________________________ JUDGMENT ______________________________________________________________________ [ 1 ] WHEREAS defendants' written motion to postpone was denied for lack of sufficient cause; [ 2 ] WHEREAS defendants were not present at trial; [ 3 ] GIVEN the evidence, including plaintiff's credible testimony and exhibits P-1 to P -9; [ 4 ] WHEREAS defendant Katdor Apartments Inc. ("Katdor") sold an immovable property to plaintiff, on January 30, 2012, for $1,475,000.00 (exhibit P-5); [ 5 ] WHEREAS , at the time of sale, Katdor's principal, defendant Steve Carson, declared, before plaintiff and notary, that the property was free and clear of all debts, when, in fact, it was not; [ 6 ] WHEREAS , at the time of sale, there was an outstanding utility debt owed to Gaz Métro in the amount of $6,399.94 (exhibits P-1, P-6 and P-7);
[ 7 ] WHEREAS deed of sale P-5 provides as follows: " RÉPARTITIONS Les parties reconnaissent avoir fait entre elles tous les ajustements requis concernant notamment les taxes municipales et scolaires, foncières et de services publics et de loyers produits par l'immeuble, s'il y a lieu, et elles s'en donnent réciproquement quittance générale et finale.
Les parties reconnaissent cependant que lesdits ajustements ont été préparés sur la foi des renseignements et documents qui étaient disponibles à la date des présentes et en cas d'erreurs ou d'omissions des préposés de la Commission Scolaire ou de la Municipalité concernées ou des parties elles-mêmes, elles s'engagent à faire entre elles tous rajustements nécessaires en date des présentes.
" [ 8 ] WHEREAS plaintiff acquitted the amount owed to Gaz Métro (exhibit P-9); [ 9 ] WHEREAS Katdor is therefore liable to plaintiff for reimbursement of the said amount, as is Carson personally (arts. 317 and 1375 of the Civil Code of Quebec ); WHEREFORE THE COURT HEREBY: GRANTS plaintiff's application, in part; CONDEMNS Katdor Apartments Inc. and Steve Carson, jointly and severally, to pay plaintiff the sum of $6,399.94, plus legal interest and the additional indemnity provided for in art. 1619 of the Civil Code of Quebec , from September 28, 2012, plus the legal fees in the amount of $167.00. __________________________________ ELIANA MARENGO, J.C.Q.
