The following is the judgment delivered by THE COURT (Orally) [ 1 ] The appellant stood trial in the Provincial Court on the following three counts: Count 1: Bon Scott TRECARTIN, on or about the 18 th day of May, A.D. 2016, at or near Bath, in the County of Carleton and Province of New Brunswick, did commit an assault on Laura Oakes with the intent to steal from her, contrary to
Section 343(
c) and in violation of Section 344(1) (
b) of the Criminal Code of Canada and amendments thereto. Count 2: Bon Scott TRECARTIN, on or about the 18 th day of May, A.D., 2016, at or near Bath, in the County of Carleton and Province of New Brunswick, with intent to commit an indictable offence, did have his face masked, contrary to and in violation of Section 351(2) of the Criminal Code of Canada and amendments thereto. Count 3: Bon Scott TRECARTIN, on or about the 18 th day of May, A.D., 2016, at or near Bath, in the County of Carleton and the Province of New Brunswick, did attempt to commit an indictable offence to wit: Robbery under
Section 343, contrary to and in violation of
Section 463 (
a) of the Criminal Code of Canada and amendments thereto. [ 2 ] He was found guilty on Count 2 (having his face masked with intent to commit an indictable offence) and Count 3 (attempted robbery). The trial judge conditionally stayed Count 1 (assault with intent to steal) and, on May 5, 2017, sentenced the appellant to consecutive terms of 28 months on Count 3 and 6 months on Count 2.
The judge also made ancillary orders pursuant to s. 487.051(1) (DNA sample) and s. 109 (lifetime prohibition against possession of any weapon) of the Criminal Code . [ 3 ] In his written and oral submissions on appeal, the appellant argued the verdicts are unreasonable. The respondent initially demurred.
However, following a fulsome debate in our Court and upon reconsideration, the respondent, while maintaining the verdict on Count 2 (being masked with intent) is reasonable and must therefore be upheld, concedes the verdict on Count 3 (attempted robbery) is unreasonable and cannot be sustained. [ 4 ] Correlatively, the respondent contends the appellant was properly convicted of the included offence of attempted theft and that the Court should therefore dismiss the appeal pertaining to Count 3 pursuant to s. 686(1)(b)(i),
substitute a verdict of attempted theft (ss. 334(b)(
i) and 463 (d)(i)) and impose a sentence that is warranted in law. In the respondent’s view, the sentence for both the offence specified in Count 2 and the offence of attempted theft included in Count 3 should be one of time served. The respondent also urges the Court to quash the aforementioned ancillary orders, and to permanently stay Count 1.
The appellant joins with the respondent in urging the Court to dispose of the appeal on those terms. [ 5 ] After due consideration, we are satisfied the proposed disposition is appropriate, and it is so ordered. [ 6 ] Given the appellant’s ongoing incarceration, these reasons will be filed in the English language and be translated at the earliest opportunity.
