Article 38 de la Loi sur la protection de la jeunesse et ordonnance de mesures intérimaires ______________________________________________________________________ [ 1 ] Le tribunal confirme et motive, par le présent jugement, la décision rendue séance tenante lors de l'audience du 29 avril 2013, conformément aux exigences de l’article 90 de la
Loi sur la protection de la jeunesse . [ 2 ] Comme le permet Kellogg’s Company of Canada c. P.G. du Québec , [1978] C.A. 258 , 259-260, le tribunal s’est réservé le droit, au moment de rendre sa décision, d’en modifier, amplifier et remanier les motifs. La soussignée les a remaniés pour en améliorer la présentation et la compréhension. [ 3 ] Le tribunal doit déterminer si la sécurité et le développement de X sont compromis et le cas échéant, pour quels motifs. [ 4 ] La Directrice de la protection de la jeunesse soutient que la sécurité et le développement de l’enfant sont compromis en application de l’article 38 b) 2 o de la
Loi sur la protection de la jeunesse . [ 5 ] Les admissions de la mère font ressortir que cet enfant était – au moment de la rédaction de la requête - à grand risque de négligence. Il faut donc s’assurer que ce risque n’existe plus, que la mère se prend en main, se trouve un logement, s’occupe de son enfant adéquatement et que la relation avec monsieur B est vraiment terminée.
Et même si la relation est terminée, il faudra s’assurer que ni la mère ni l’enfant ne sont en danger puisque cet homme semble être particulièrement agressif. [ 6 ] À la procédure on retrouve les allégations suivantes, admises par la mère : « 3.1 on February 2 nd , 2013, the Director of Youth Protection received a signalement concerning the child; 3.2
a) the mother reported being a victim of conjugal violence at the hands of her boyfriend, Mr. B throughout her pregnancy;
c) Mr. B slapped the mother, called her names and broke ten mobile phones that belonged to her;
d) Mr. B threatened to kill the mother’s parents and to burn down their house; 3.3 charges were filed against Mr(sic) B by the mother’s parents and conditions currently prevail where he is to have no contact with them; 3.4 the mother lived in a shelter during her pregnancy with the child but reunited with Mr(sic) B on two (2) occasions, despite the incidents of conjugal violence she suffered;
3.5 in December 2012, the mother moved in an apartment of her own; 3.6 more recently, the mother allowed Mr(sic) B in the hospital room during her hospitalization for the child’s birth despite his volatility and threats made to her; 3.7 the mother has filed charges in the past against Mr(sic) B but also withdrew them on at least one occasion; 3.8 on February 5 th , 2013, Mr(sic) B broke in the mother’s apartment; 3.9 on February 6 th , 2013, the mother filed for a restraining order against Mr(sic) B; 3.10 the mother suffers from a bipolar disorder and is allegedly followed in outpatient services; ». [ 7 ] Heureusement, le grand-père maternel accepte de prendre charge de l’enfant et de sa mère. [ 8 ] Voilà pourquoi la Directrice de la protection de la jeunesse demande de prononcer une ordonnance intérimaire pour une période d’environ 2 mois. [ 9 ] Après avoir reçu les admissions, pris en considération la position des parties et la preuve testimoniale et documentaire, le tribunal conclut à l'existence de motifs sérieux de compromission en application de l'article 38 b) 2 o de la
Loi sur la protection de la jeunesse et estime qu'il est dans l'intérêt de l'enfant et le respect de ses droits de rendre l'ordonnance qui suit. [ 10 ] PAR CONSÉQUENT ET POUR CES MOTIFS, LE TRIBUNAL : [ 11 ] GRANTS the motion; [ 12 ] DECLARES that the security and the development of X are in danger (section 38 b) 2 o of the Youth Protection Act ); [ 13 ] SETS the continuation of the hearing on July 3, 2013 in room 2.04 before the undersigned; [ 14 ] In the meantime: [ 15 ] ENTRUSTS the child to the care of his maternal grandfather, M.
C; [ 16 ] TAKES JUDICIAL NOTICE that mother will be residing in the home; [ 17 ] ORDERS that the contacts between the child and his father be determined by the Director of Youth Protection; those contacts will have to be supervised and will have to take place in a neutral milieu; [ 18 ] PROHIBITS Mrs. A and Mr.
B from being together in the presence of the child; [ 19 ] RECOMMENDS mother to continue to seek mental health services and to engage in specialized services to address the dynamics of conjugal violence; [ 20 ] RECOMMENDS father to undergo a psychiatric assessment; [ 21 ] RECOMMENDS father to submit to random drug and alcohol testing; [ 22 ] ORDERS the parents to meet with the delegate when requested and to inform the delegate within 24 hours of any change in his address or telephone number; [ 23 ] ORDERS that the child receives all the services he needs; [ 24 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to X and his family; [ 25 ] ENTRUSTS the situation of X to the Director of Youth Protection A, who shall then see that the measures are carried out; [ 26 ] ORDERS the execution of the present decision by any peace officer. [ 27 ] This decision is enforceable from the moment it is made and any person referred to therein shall comply forthwith and notwithstanding an appeal ( Articles 93 and 105 of the Youth Protection Act ). __________________________________ DOMINIQUE WILHELMY, J.C.Q.
