Robert Osadchuck Clerk BY THE COURT JUDGMENT [ 1 ] WHEREAS Randall Conners seeks to adduce new evidence in respect of the appeal, namely an affidavit sworn by Ms. Joyce King as well as copies of two Agreements relating to aboriginal offenders; [ 2 ] WHEREAS the appellant, represented by both the Federal and the Provincial Crown, does not contest that the evidence submitted constitutes fresh evidence pursuant to
section 683 Cr.C . and the applicable jurisprudence; [ 3 ] WHEREAS the appellant, Federal Crown, seeks nevertheless to cross-examine the affiant; [ 4 ] WHEREAS the respondent Conners does not contest this latter request; [ 5 ] CONSIDERING that it is in the interest of justice to allow the respondent to constitute the proposed fresh evidence and authorize the cross-examination of the affiant; [ 6 ] CONSIDERING that the date fixed for the hearing of the appeal must be rescheduled in order to accommodate the constitution of this fresh evidence; FOR THE FOREGOING REASONS, THE COURT: [ 7 ] GRANTS the motion to adduce fresh evidence in part; [ 8 ] AUTHORIZES the respondent to file: 1.
The affidavit dated August 15, 2017 sworn by Ms. Joyce King; 2. King on her affidavit; [ 10 ] REFERS the question as to the admissibility of the aforementioned fresh evidence and, should it be judged admissible, the probative weight that should be assigned thereto to the bench that will hear the appeal on the merits; [ 11 ] ORDERS that the fresh evidence and the stenographic notes for the cross-examination be filed as soon as possible; [ 12 ] POSTPONES the appeal scheduled for November 24, 2017 and reschedules the said appeal for April 27, 2018 in Pierre-Basile- Mignault courtroom for a duration of 105 minutes (45 minutes for the appellant Federal Crown; 45 minutes for the respondent Conners; 15 minutes for the Provincial Crown). marie-france bich, j.a.
