Section 95 of the Youth Protection Act CQLR c. P-34.1 ) ______________________________________________________________________ WARNING: The Youth Protection Act forbids the publishing or broadcasting of information allowing for a child or the child’s parents to be identified.

Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] The Director of Youth Protection submits an application asking the Court for an extension of the previous Court order rendered by Judge Dominique Wilhelmy, on July 3, 2019, entrusting the children to their parents along with various assistance measures. [ 2 ] Both parents are present and represented by Mtre. Michel Grenier. Mtre. Yan Massé acts on behalf of the children while Mtre.

Magdalena Lempicka represents the applicant. [ 3 ] The application is neither challenged by the parents nor by the children. [ 4 ] The children are living with their parents since April 2019, and the situation has significantly improved. [ 5 ] The four oldest children told the Social Worker that they feel safer now with their parents and that they have a stronger connection with them. There is less alcohol consumption and only one event has happened during the last year when, in February 2020, a verbal argument occurred between the parents.

At that time, the emergency worker went to the parents’ place to find that the children were alone, the older children taking care of the younger ones. The parents were nowhere to be seen. [ 6 ] Since then, nothing else has happened. [ 7 ] The situation of the parents is still fragile and still requires help. The main measure is for the parents to meet with the NNADAP worker or to attend a treatment program. The parents state that they would like to be part of a bush program organized by people of their community. They are collaborative with the Social Worker.

The Court hopes that they will continue their involvement in receiving help. It is in the best interest of their children for them to maintain their new lifestyle. [ 8 ] The children are of the opinion that help is still needed. [ 9 ] FOR THESE MOTIVES, THE COURT: [ 10 ] GRANT the application; [ 11 ] DECLARES that the security and the development of the children are still endangered; [ 12 ] ORDERS the parents to seek help for their substance abuse issues, which could be done via a bush program if it is their wish;

[ 13 ] ORDERS that aid, counselling and assistance be provided to the family for a period of six months; [ 14 ] ORDERS the parents to participate actively to the application of the measures ordered by the Court and to fully collaborate with the Director of Youth Protection; [ 15 ] AUTHORIZES any service providers to share information with the Director of Youth Protection during the next six months starting on June 16, 2020; [ 16 ] ENTRUSTS the situation of the children to the Director of Youth Protection for the execution of the Court orders. __________________________________ LUCILLE CHABOT, J.C.Q.
