JUDGMENT The appeal from the judgment of the Court of Appeal for Ontario, Number C66280, 2022 ONCA 534 , dated July 18, 2022, was heard on October 13, 2023, and the Court on that day delivered the following judgment orally: Kasirer J. — We are all of the view that the majority in the Court of Appeal was correct to conclude that party liability was properly left to the jury by the trial judge. The evidence on the record provided party liability with an air of reality. We agree, however, with Nordheimer J.A., dissenting, that the trial judge erred in law in his instructions on party liability.
In one part of the charge, the judge gave instructions that resembled co-principal liability, but said he was instructing on aiding. In other parts of the charge, the jury was given partially correct instructions on aiding. We share Nordheimer J.A.’s view that the jury was never clearly told that the appellant would have needed to know that the principal intended to kill the victims in a planned and deliberate manner in order to be liable for first degree murder as an aider. That said, we would apply the curative proviso in s. 686(1)(b) (iii) of the Criminal Code , R.S.C. 1985, c.
C-46 , because these errors were harmless. There is no reasonable possibility that the jury would have reached a different verdict had these errors not been made (see R. v. Abdullahi , 2023 SCC 19 , at para. 33 ; R. v. Sarrazin , 2011 SCC 54 , [2011] 3 S.C.R. 505, at para. 25 ). The evidence that supported party liability was the same as the evidence for co-principal liability. Moreover, the appellant’s defence was not undermined by the jury charge. Accordingly, we would dismiss the appeal.
JUGEMENT L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C66280, 2022 ONCA 534 , daté du 18 juillet 2022, a été entendu le 13 octobre 2023 et la Cour a prononcé oralement le même jour le jugement suivant : [ traduction ] Le juge Kasirer — Nous sommes tous d’avis que les juges majoritaires de la Cour d’appel ont eu raison de conclure que la responsabilité en tant que participant a été soumise à juste
titre au jury par le juge du procès. La preuve au dossier conférait de la vraisemblance à la responsabilité à
titre de participant. Nous sommes toutefois d’accord avec le juge d’appel Nordheimer, dissident, pour dire que le juge du procès a fait erreur en droit dans ses directives sur la responsabilité à
titre de participant. Dans une
partie de l’exposé, le juge a donné des directives qui ressemblaient à celles concernant la responsabilité à
titre de coauteur de l’infraction, mais il a dit qu’il donnait des instructions sur l’aide à commettre l’infraction. Dans d’autres parties de l’exposé, le jury a reçu des directives partiellement correctes sur l’aide à commettre l’infraction. Nous partageons l’opinion du juge d’appel Nordheimer selon laquelle il n’a jamais été dit clairement au jury qu’il était nécessaire, pour que l’appelant soit responsable de meurtre au premier degré en tant que personne ayant aidé à commettre l’infraction, qu’il ait su que l’auteur principal avait l’intention de tuer les victimes avec préméditation et de propos délibéré.
Cela dit, nous sommes d’avis d’appliquer la disposition réparatrice prévue au sous-al. 686(1)b)(iii) du Code criminel , L.R.C. 1985, c. C-46 , étant donné que ces erreurs étaient inoffensives. Il n’existe aucune possibilité raisonnable que le jury serait arrivé à un verdict différent si ces erreurs n’avaient pas été commises (voir R. c. Abdullahi , 2023 CSC 19 , par. 33 ; R. c. Sarrazin , 2011 CSC 54 , [2011] 3 R.C.S. 505, par. 25 ). La preuve qui appuyait la responsabilité à
titre de participant était la même que celle appuyant la responsabilité en tant que coauteur. De plus, la défense présentée par l’appelant n’a pas été minée par l’exposé au jury. En conséquence, nous sommes d’avis de rejeter l’appel. J.S.C.C. J.C.S.C.
