Date of Hearing: March 2, 2017 Date of Judgment: March 2, 2017 [ 1 ] THE COURT: Very well, Mr. Wiebe, I have considered the circumstances. I have before me a joint submission, which I accept. [ 2 ] I will place you on probation for a period of 12 months.
The conditions are that you are to keep the peace and be of good behaviour. You are to appear before the court as and when required to do so by a justice. You are to notify the justice or a person designated by the justice in advance of any change in your name or address, and promptly of any change in the defendant's employment or occupation. [ 3 ] You are to report in person to a probation officer here in Courtenay, no later than four p.m. today and thereafter as and when
directed by your probation officer.
You are to advise the probation officer of your residential address and telephone number, and not change your address or telephone number without notifying the probation officer in advance in writing. [ 4 ] Under the direction and supervision of your probation officer you shall successfully complete 50 hours of community work service, the work service is to be completed at the direction of, and to the satisfaction of your probation officer, and must be completed within the first 10 months of the 12 month probation order. [ 5 ] In addition, there will be an order, under s. 24(3) of the Prevention of Cruelty to Animals Act that for a period of 10 years you are not to own, or have custody or control of an animal. [ 6 ] MR.
YEO: Thank you, Your Honour. [ 7 ] THE COURT: That is it. Okay. [ 8 ] THE ACCUSED: Thank you, Your Honour. [ 9 ] THE COURT: Okay. Thank you. [ 10 ] THE CLERK: And the victim surcharge, Your Honour? [ 11 ] THE COURT: If there is a victim fine surcharge, I order that it be paid immediately, find he is not capable of doing, so I find him in default, and direct the default time be concurrent, he does not need to be taken into custody. [ 12 ] MR. YEO: Thank you, Your Honour. [ 13 ] THE ACCUSED: Thank you, Your Honour. (REASONS FOR SENTENCE CONCLUDED)
