N o : 525-41-014142-038 DATE : 1er octobre 2013 ______________________________________________________________________ SOUS LA PRÉSIDENCE DE : L’HONORABLE JUGE LUCIE GODIN, J.C.Q. ______________________________________________________________________ Dans la situation de l'enfant : X Née […] 1998 [INTERVENANTE 1] , personne autorisée par la Directrice de la protection de la jeunesse La personne déclarante -et- B -et- A Les parents mis en cause ______________________________________________________________________ JUGEMENT ______________________________________________________________________ [ 1 ] À la demande et du consentement de toutes les parties, le Tribunal procède à une enquête commune dans la situation des enfants X et Y. [ 2 ] Le Tribunal est saisi d'une requête en prolongation d'une ordonnance rendue le 15 octobre 2012 dans laquelle il déclarait que la sécurité et le développement de l'adolescente demeuraient compromis et ordonnait son hébergement en centre de réadaptation dont les coordonnées devaient demeurer confidentielles, de même que certaines autres mesures visant à corriger la situation.
L'ordonnance prenait fin le 30 juin 2013. [ 3 ] La Directrice de la protection de la jeunesse allègue que la situation de l'adolescente exige une prolongation d'ordonnance pour certains motifs liés à l'absence du père, au type de lien qu'entretient la mère avec sa fille, de même que certaines difficultés vécues par l'adolescente exigent l'intervention de la Directrice. [ 4 ] En conséquence, la Directrice recommande au Tribunal d'ordonner le maintien de l'adolescente en centre de réadaptation pour une période d'une (1) année et d'autoriser sa réintégration en famille d'accueil si la situation le permet.
La Directrice recommande certaines autres mesures visant à répondre aux besoins de santé de l'adolescente. État de compromission [ 5 ] Le père est absent à l'audience, il n'entretient aucun contact avec son enfant. [ 6 ] La mère est absente, et ce malgré que le 4 septembre 2013, le Tribunal reportait l'audience pour permettre à la mère de se présenter à la cour. [ 7 ] L'adolescente, par le biais de son procureur, admet l'essentiel des faits allégués. Cependant, elle ignore que sa mère a donné naissance en février 2013.
Quant au suivi psychologique, elle viendrait tout juste de le reprendre. [ 8 ] Elle nie avoir manifesté un comportement général marqué par la provocation tout au long de son hébergement en centre de réadaptation.
[ 9 ] L'adolescente reconnaît avoir fugué du centre de réadaptation, mais nie qu'elle se soit placée en situation de danger. [ 10 ] Tenant compte des admissions formulées par l'adolescente et de la preuve documentaire, le Tribunal conclut que la sécurité et le développement de l'adolescente demeurent compromis et que sa situation exige une prolongation d'ordonnance pour les motifs allégués. [ 11 ] Le Tribunal retient les éléments suivants: ➢ There have been no contacts between the adolescent and the father; ➢ The mother maintained regular telephone contact with X until around February 2013; ➢ The mother gave birth in February 2013; ➢ The mother is said to have relocated to City A around May 2013, she has made no attempt to contact the delegate or the adolescent since then; ➢ On April 11, 2013, X disclosed that she had been the subject of sexual abuse at the hands of the previous foster father, D, as a result, contacts with the organism A have been suspended; ➢ The adolescent has remained in a rehabilitation centre where her behaviour has been increasingly challenging; ➢ The adolescent continue to benefit from regular psychological follow-up; ➢ The adolescent has been running away from the rehabilitation centre and placing herself at risk in the community; ➢ The adolescent requires a stable environment, which can provide structure and supervision.
Mesures [ 12 ] Tout d'abord, la Directrice allègue dans sa requête que l'adolescente a signalé le fait qu'elle aurait été victime d'abus sexuels de la part de D, père de la famille d'accueil à qui elle fut confiée. [ 13 ] Dans son rapport, la Directrice souligne que ce signalement a été évalué et a été retenu comme fondé. [ 14 ] Cette situation est extrêmement grave et doit être prise au sérieux dans la manière dont le suivi social est dispensé à l'adolescente. [ 15 ] Elle vit avec les séquelles des abus dont elle fut victime dans son milieu familial dans sa tendre enfance.
Elle a à nouveau été victime dans un milieu familial substitut qui avait la vocation de la protéger. [ 16 ] La Directrice devra être sensible et vigilante afin de bien répondre aux besoins de l'adolescente. [ 17 ] Quant aux contacts entre l'adolescente et sa mère, l'intervenante sociale note: «Since the last hearing in 2012-10-15 there has been some significant changes with X. Primarily, the day of the court hearing X was able to meet her biological mother Ms. B after several years of having very minimal contact with her. X was given the opportunity to speak with Ms. B however; she was not very open in doing so.
Instead her younger sister X spoke to Ms. B asking her multiple questions while X sat quietly. It was granted at court that both girls could begin to communicate with their mother with supervised phone conversations and with time eventually have a supervised visit. X was in agreement with this plan, and informed the undersigned that she was content her sister was able to meet her mother. Following the court hearing, X voiced to the undersigned that she was not emotionally ready to begin telephone conversations with her mother and would inform the undersigned when she felt more emotionally prepared.
Throughout the months of October and November of 2012, X began asking the undersign to contact her mother requesting that her mother grant her smoking privileges at A, to dye her hair and pierce her body. The undersigned spoke to X in regards to the importance of building a healthy relationship with her mother and not simply communicating with her mother solely for her materialistic purposes. Ms. B did grant X permission to dye her hair, but refused her other requests stating that she did not want X to smoke and receive piercings as it is against her religious beliefs. Ms.
B on 2013-01-08 informed the undersigned that she was not ready to speak to X on the phone, as she had recently begun speaking to her sister X over the phone and wanted to establish their relationship first. The undersigned informed X of Ms. B's decision; X was in agreement with Ms. B's decision. X spoke to Ms, B beginning in mid January every Monday until the beginning of March for approximately fifteen minutes on the phone supervises by staff. On 2013-03-22, the undersigned was informed that Ms. B had left City B without any prior notification and was presently residing in Toronto with her family.
The undersigned tried contacting Ms. B via her cellular phone however, the phone line was disconnected. To date there has been no contact between Ms. B, X and X.» [1] [ 18 ] Ainsi, concernant les contacts entre l'adolescente et sa mère biologique, l'intervenante sociale analyse ainsi la situation: «X has not spoken or seen her biological mother since 2012-10-15. Ms. B has not contacted the undersigned since her move to City A. X speaks to her sister X on a regular basis via telephone. There is no fix
schedule of visits; however X tends to visit X at least once month at her sisters group A. X more recently has not spoken to Ms. B since her allegations on 2013-04-01. Prior to the allegations X would visit Ms. B almost every
Tuesday after school before attending her Pathfinders group and would have phone conversations when needed.» [2] [ 19 ] Quant à la nécessité d'intervention de la Directrice, l'intervenante s'exprime ainsi: «On going DYP involvement is needed to provide structure and support for X. Aside from her group A and her younger sister X, X has no family support in City B and therefore, providing X with social and emotional support is very much needed.
Furthermore, X's unaddressed past history of abuse continues to affect the decisions she makes and therefore, aid, counsel and assistance is needed to ensure X safety and well being is not compromised.» [3] [ 20 ] Les objectifs visés par les recommandations sont les suivants: «The goal is to keep X at her present group A while helping her to receive the services needed to address and cope with her past history of abuse and ensuring she maintains contact with her sister X.» [4] [ 21 ] Tenant compte de la position exprimée par l'adolescente, de la preuve documentaire, le Tribunal conclut que les recommandations de la Directrice sont dans l'intérêt de l'adolescente. [ 22 ] PAR CES MOTIFS, LE TRIBUNAL : [ 23 ] GRANTS the motion; [ 24 ] EXTENDS the decisions that were rendered on October 15, 2012; [ 25 ] ORDERS that X remain in a rehabilitation center for a period of one (1) year as of today; [ 26 ] AUTHORIZES X's integration into a foster home if the situation allows; [ 27 ] ORDERS that X continue to participate in psychological counselling; [ 28 ] ORDERS X to refrain from using drugs or drinking alcohol; [ 29 ] ORDERS that contacts between X and her sister X be encouraged; [ 30 ] ORDERS that Director of Youth Protection determine the frequency and modality of contacts between X and her mother, taking into consideration the adolescent's best interest and her wishes; [ 31 ] WITHDRAWS from the parents the attributes of parental authority with respect to signing all consents for X related to health, travel, passports, school, activities, etc; [ 32 ] AUTHORIZES the Director of Youth Protection to sign all consents for X related to health, travel, passports, school, activities, etc; [ 33 ] PROHIBITS any type of contacts between X and her father; [ 34 ] ORDERS that aid, counsel and assistance be provided to X and her family for a period of one (1) year as of today; [ 35 ] ENTRUSTS the situation of X to the Director of Youth Protection for the execution of the present judgment. __________________________________ LUCIE GODIN, J.C.Q.
