René Gutknecht, Clerk at the hearing JUDGMENT [ 1 ] On April 1 st 2021, the applicant was founded guilty by a jury for 10 armed robberies of banks and for unlawful possession of a loaded firearm. [ 2 ] On April 30 th 2021, his lawyer informed the respondent’s lawyer of his intention to appeal the verdict. [ 3 ] On February 1 st 2022, the applicant filed the present motion to extend the time for appealing essentially on the ground that he was unable to appeal the judgment in the prescribed appeal period despite his efforts to find a lawyer to represent him on appeal under a Legal Aid mandate. [ 4 ] The respondent contests this motion. [ 5 ] The conditions required for extending the period to file an appeal are described by Justice Kasirer [1] : [16] La requête pour permission d’appeler hors délai est régie par l’article 678(2) C.cr .
La jurisprudence exige que le requérant démontre (
i) qu’il avait l’intention d’interjeter appel du jugement à l’intérieur du délai imparti, (ii) qu’il a fait preuve de diligence raisonnable dans l’exercice de son droit d’appel, et (iii) qu’il a des motifs soutenables au soutien de l’appel demandé : Lamontagne c. R. […] [18] Les divers éléments pertinents à l’évaluation d’une requête présentée en vertu de l’ article 678(2) C.cr . sont en fait des composantes de l’intérêt de la justice qui doit guider l’exercice du pouvoir discrétionnaire du juge autorisateur. Cette approche a été confirmée récemment par la Cour d’appel de l’Ontario dans l’arrêt Ansari .
La Cour y souligne que l’ article 678(2) C.cr . ne prévoit pas formellement de « test » à appliquer, ni ne décrit d’ailleurs les facteurs à être considérés aux fins de déterminer si la prorogation devrait être accordée.
Elle rappelle aussi le caractère discrétionnaire de cette détermination et précise, après avoir passé en revue les facteurs énoncés précédemment, que : [References omitted] [ 6 ] Considering that these conditions are satisfied and that the interest of justice favours granting the motion; FOR THE FOREGOING REASONS, THE UNDERSIGNED: [ 7 ] EXTENDS the delay to appeal the judgment rendered on April 1 st , 2021; [ 8 ] ALLOWS the filing of the notice to appeal.
