12 h 33 Début de l’audience. Me Girard-Leduc, représentant de l’intimée, est entendu pour répondre aux interrogations de la Cour. PAR LA COUR : Arrêt rendu séance tenante – voir page 3 Francesca Pierre-Antoine, Greffière-audiencière ARRÊT [ 1 ] L’appelant a été accusé de vol d’une valeur dépassant 5 000 $ (art. 334a) C.cr. ). Seuls le plaignant et l’appelant ont témoigné au procès.
Ils ont offert des versions diamétralement opposées. [ 2 ] La juge de première instance a rendu son jugement oralement à la fin des plaidoiries. Elle a déclaré l’appelant coupable pour les motifs ici reproduits intégralement : LA COUR : Okay. So we heard two (2) versions of what happened on March the twenty-ninth (29 th ), two thousand sixteen (2016), here in Laval. Of course, they are not the same versions. Otherwise, there would not be a trial. But honestly, after hearing that, if the accused would tell me that the earth is round, I would have a doubt.
The defence says that he was coherent, clear and that everything was perfect on behalf of the accused when he testified. Well first, for me, I cannot understand this explanation regarding how he would tell Mr. Shalash how to go to Saint-Michel and the explanation concerning the phone call and he missed the phone calls because he was in the school and then, he called him back, and then, he was lost but still in Laval and he told him to take the 19. This is, for me, this is not clear at all, it makes no sense at all.
And things that are sure it’s that the victim had withdrawn six thousand two hundred dollars ($6,200) this day and he says that this amount of money with the three thousand (3,000) that he had before, it has been taken from him in the parking lot near the Amir restaurant. I did not understand as well the explanation regarding who he was… who he was going to pick up at the school, at first, we… it was not clear and finally, we are talking about niece and nephews and so on and so forth. No, I give no credibility at all to the accused, when he testifies.
And this being said, I’m convinced that the proof has been made that on March the twenty-ninth (29 th ), he took nine thousand dollars ($9,000) from Mr. Ahmad Shalash. So he’s found guilty on the charge as laid. [ 3 ] L’appelant soutient que la juge a rejeté son témoignage de façon illogique ou irrationnelle, de sorte que le verdict est déraisonnable au sens de l’arrêt R. c. Beaudry , 2007 CSC 5 , paragr. 105 . [ 4 ] Il a raison. Le seul fait que la juge n’ait pas compris les explications de l’appelant ne justifie pas sa conclusion.
À l’instar des perceptions du juge sur l’attitude d’un témoin : LSPJA – 1521 , 2015 QCCA 1229 , paragr. 28 , le manque de clarté d’un témoignage selon l’appréciation purement subjective du juge ne peut devenir l’unique point déterminant de l’analyse de la crédibilité d’un témoin et
l’assise d’un verdict de culpabilité. [ 5 ] De plus, à la lecture de la transcription du témoignage de l’appelant, on cherche en vain ce que la juge n’a pas compris. L’explication de l’appelant sur les indications qu’il a données au plaignant pour se rendre à Saint-Michel sont tout à fait compréhensibles et plausibles, tout comme son témoignage sur la conversation téléphonique qu’il a eue avec le plaignant par la suite. [ 6 ] De même, s’il est vrai que l’appelant a mentionné à un moment qu’il devait aller chercher sa fille, il a aussitôt précisé « the kids ».
Il venait tout juste de dire qu’il devait aller chercher les enfants. Lorsque contre-interrogé sur le sujet, son témoignage est des plus clairs et précis. [ 7 ] Bref, les raisons que la juge a données pour ne pas croire l’appelant ne tiennent pas. Il faut conclure que le verdict est déraisonnable parce qu’il n’a pas été rendu « de manière judiciaire » : Sinclair , paragr. 26. POUR CES MOTIFS, LA COUR : [ 8 ] ACCUEILLE l’appel; [ 9 ] CASSE le verdict de culpabilité; [ 10 ] ORDONNE la tenue d’un nouveau procès. YVES-MARIE MORISSETTE, J.C.A. SUZANNE GAGNÉ, J.C.A.
