ÉRIK PÉLADEAU and 4429419 CANADA INC. and JOSEPH MONTANARO Defendants ______________________________________________________________________ JUDGMENT ______________________________________________________________________ [ 1 ] WHEREAS a judgment was rendered by default, in this matter, on April 8, 2019; [ 2 ] WHEREAS the undersigned granted defendants’ applications for revocation of said judgment, for the reasons rendered verbally at trial; [ 3 ] WHEREAS plaintiff is suing defendants, in damages; [ 4 ] WHEREAS plaintiff bought an immovable from defendant Érik Péladeau, on September 8, 2016 (deed of sale, exhibit P-1); [ 5 ] WHEREAS , in her application dated June 23, 2017, plaintiff alleges, inter alia , the following: “3.
Plaintiff hereby furthermore declares that before purchasing the said immoveable she and her husband Gaetano (Jimmy) Gioia were provided with a listing relating to the said immoveable prepared by Defendant 4429419 Canada Inc. (hereinafter referred to as “Sotheby’s”) and/or Defendant Joseph Montanaro, all of which is confirmed from copy of said listing which is attached hereto and which shall henceforth be referred to as Exhibit P-2 en liasse ; 4.
As can be noted from an examination of said listing, Exhibit P-2 en liasse, Defendant Montanaro and Corporate Defendant represented that the said immoveable was equipped with the following services, namely: Air exchange System, Central vacuum cleaner System installation, Alarm System, Central heat pump; 5. That Defendant Péladeau approved the contents of the said listing, Exhibit P- 2 en liasse, and/or is presumed to have approved of the contents of the said listing, including the contents thereof; 6.
Soon after Plaintiff and her husband took possession of the said immoveable bearing civic address [...], Lorraine, Quebec, it was brought to the attention of both Plaintiff and her husband Gaetano (Jimmy) Gioia that notwithstanding the representations of Defendants the said immoveable did not include a central heat pump, with the result being that the representations set out by Corporate Defendant as well as Defendants Montanaro and Péladeau in said listing, Exhibit P-2 en liasse, upon which Plaintiff relied, were false; 7.
In consequence thereof Plaintiff maintains that all Defendants are solidarily liable and indebted to Plaintiff for the said false representations; […] ʺ [ 6 ] WHEREAS the listing on which the claim is founded (exhibit P-2) states, inter alia , the following:
ʺ Features […] Equipment/Services Air exchange system, Central vacuum cleaner system installation, Alarm system, Central heat pump ʺ (page 2) [ 7 ] WHEREAS , before purchasing it, plaintiff had the property inspected ( rapport d’inspection préachat , exhibit P-5); [ 8 ] WHEREAS , on pages 42 and 43 of said report, dated July 20, 2016, ʺinspecteur agrééʺ Sylvain Trudel wrote: « CLIMATISATION ET POMPE À CHALEUR Méthodes d’inspection Les systèmes d'air climatisé ou de thermopompe sont vérifiés et opérés aux conditions climatiques présentes durant l'inspection et ils seront indiqués comme étant opérationnels ou non.
Il n’y a pas d'inspection en profondeur des composantes du système. Une inspection en profondeur ne peut qu'être faite par un technicien spécialisé en climatisation. Si une panne survient après l’inspection, l'acheteur devra être averti ou une inspection pré-notariale pourrait être fixée par l'acheteur. Il est toujours recommandé qu'un plan d'assurance pièces et main-d'œuvre soit maintenu en vigueur pour le nettoyage annuel et le service d'urgence durant l'année. Les unités de climatisation et les thermopompes, comme tout appareil mécanique peuvent faire défaut en tout temps.
Matériel de refroidissement et de ventilation P/V Constatations Information Nous avons examiné visuellement la thermopompe qui fonctionnait normalement lors de notre visite. Cependant, seule une inspection par un technicien compétent muni d'un manomètre pourrait nous éclairer sur la condition réelle de l’appareil. Nous vous conseillons de vous munir d'un contrat d'entretien pour ce système. Plusieurs composantes internes doivent être nettoyées régulièrement (condensateurs et évaporateurs) et des ajustements sont à faire à l’occasion.
Système de distribution P/V Constatations Inspection limitée Nous n'avons pas pu observer les serpentins de la thermopompe au plénum de la fournaise. Si les serpentins sont sales, cela réduit l'efficacité de la thermopompe. Nous vous recommandons de faire nettoyer les serpentins régulièrement. » (photos omitted) [ 9 ] WHEREAS the letters ʺP/Vʺ are defined as follows on page 6 of the report: « P/V (partiellement vérifié) La composante n’est observable qu’en partie. Son appréciation par l’inspecteur est donc limitée à la
partie visible. » [ 10 ] WHEREAS Péladeau stated that he lived in the property for 11 years and never experienced any problems with the ʺthermopompeʺ, both in terms of heating and cooling; [ 11 ] WHEREAS , on January 18, 2017, plaintiff’s lawyer sent the following demand letter to Péladeau: ʺ MR. ÉRIK PÉLADEAU [...] January 18th, 2017 Laval, (Québec) [...] Re: Mr. Jimmy Gioia vs. Yourself Dear Sir
Kindly be advised that our law firm’s services have been retained by Mr. Jimmy Gioia, the whole with respect to his purchase from you of the immoveable bearing civic address [...], Lorraine, Québec, [...]. As you are no doubt well aware you and/or your real estate agent (broker), for whose acts you are legally liable and responsible, stipulated and furthermore represented in the listing of Sotheby’s International Realty Québec that your aforesaid immoveable was equipped with a central heat pump.
Notwithstanding your aforesaid representations and warranties you also know full well that the immoveable you sold my client was not equipped with a central heat pump. The cost of purchasing a central heat pump amounts to $10,000.00 plus applicable taxes, namely $11,497.50, which amount my client hereby claims from you.
In addition to the foregoing I have been instructed by my client to formally advise you that he is also holding you liable and responsible for the damage sustained to one of the bedrooms forming part of the said immoveable which sustained considerable water damage emanating from the roof, and this very shortly after my client took possession of the said immoveable. Be furthermore advised that the cost of effecting the required repairs to correct said latent defect amounts to $6,000.00 plus applicable taxes, namely $6,898.50, which my client also claims from you.
Aside and apart from the foregoing I draw to your attention that although the Sotheby listing indicated that your immoveable was equipped with three fireplaces, two of the said fireplaces were defective, with the result being that my client shall incur as much as $10,000.00 in expenses, plus applicable taxes, namely $11,497.50, in order to install brand new lines on two of the fireplaces.
Be therefore advised that unless I am in receipt of your cheque drawn to my law firm’s order for a sum of $29,893.50, plus my letter fee of $25.00, and this within the next ten (10) days, the appropriate legal proceedings shall immediately thereafter be instituted against you, and this without further notice or delay. AND DO YOU GOVERN YOURSELF ACCORDINGLY.
SHAFFER & ASSOCIATES ʺ (exhibit DP-2) [ 12 ] WHEREAS , on January 30, 2017, Péladeau’s lawyer responded as follows: « Montréal, le 30 janvier 2017 Me Harvey Earl Shaffer SHAFFER & ASSOCIÉS 5000, rue Buchan, suite 2002 Montréal (Québec) H4P 1J2 Objet : Érik Péladeau c. Jimmy Gioia Sujet : Propriété sise au [...], Lorraine (Québec) N/D: 1914-00017 V/D: HS 3422-12 Me Shaffer, Les soussignés sont les avocats de Monsieur Érik Péladeau, lequel nous a donné mandat de représenter ses intérêts relativement à l’affaire mentionnée en exergue.
Notre client nous a transmis copie de votre mise en demeure portant la date du 18 janvier 2017, laquelle fut reçue le 23 janvier 2017 à son adresse d’affaires. M. Péladeau nous a également fait part des faits pertinents. Notre client, et notre lecture des documents nous porte à souscrire à son opinion, est d’avis que les allégations du vôtre sont fausses ou imprécises.
Dans les circonstances, vous aurez l’obligeance de nous faire parvenir copie de tous les rapports d’inspection préachat, rapports d’expert, estimations, photographies et factures, de manière à ce que nous puissions évaluer les dénonciations énoncées dans votre mise en
demeure. Lorsque nous aurons reçu ces documents, nous serons mieux en mesure d’évaluer le sérieux de la réclamation, si tant est qu’il y en ait vraiment une. Bien que notre client nie catégoriquement que sa responsabilité soit engagée, il n’en demeure pas moins que si votre client persiste dans ses démarches, le nôtre insistera pour qu’un expert dont il retiendra les services puisse inspecter la propriété, pour lui faire part de ses recommandations. Il réclamera évidemment le coût de cette démarche au vôtre, en raison de son caractère fantaisiste.
Vous indiquerez également à votre client qu’il est prié de ne pas entreprendre quelques travaux que ce soit, d’ici là, à défaut de quoi un tel geste lui serait reproché, dans le cadre d’une éventuelle contestation d’une réclamation de sa part. Si cette méthode ne vous convient pas, vous aurez l’extrême courtoisie de communiquer avec les soussignés, à votre plus prochaine convenance. Bien entendu, la présente vous est faite sans préjudice aux droits et recours de notre client et sans admission de quelque que ce soit à son encontre.
En espérant le tout à votre entière satisfaction, veuillez agréer, Me Shaffer, l’expression de nos sentiments distingués. ALAIN MONGEAU, AVOCATS » (exhibit DP-3) [ 13 ] WHEREAS , however, as appears from the ʺrapport de serviceʺ and invoice dated January 24, 2017, as well as proof of payment-cheque dated January 27, 2017, plaintiff proceeded with the work described therein, without first advising defendants, in writing, as required by sections 1595 ff. and
section 1739 of the Civil Code of Québec ; [ 14 ] WHEREAS this alone is sufficient grounds for dismissing plaintiff’s claim; [1] [ 15 ] WHEREAS , in Drapeau c. Normandeau et Charest , [2] the honourable Virgile Buffoni decided as follows: « [19] De plus, l'acheteur qui constate l'existence d'un vice doit non seulement le dénoncer promptement, selon l'
article 1739 C.c.Q. , mais doit aussi mettre son débiteur en demeure, par écrit, et ce, avant l'exécution des travaux de réparation afin de permettre à son débiteur de vérifier l'existence du vice et d'y remédier, le cas échéant. [20] L'
article 1595 C.c.Q. est à l'effet suivant: " Art. 1595. La demande extrajudiciaire par laquelle le créancier met son débiteur en demeure doit être faite par écrit.
Elle doit accorder au débiteur un délai d'exécution suffisant, eu égard à la nature de l'obligation et aux circonstances; autrement, le débiteur peut toujours l'exécuter dans un délai raisonnable à compter de la demande." [21] La jurisprudence a maintes fois affirmé le principe qu'une omission d'envoyer une telle mise en demeure par écrit avant l'exécution des travaux de réparation est fatale au recours du demandeur. [22] Drapeau n'a pas non plus fait la preuve d'une situation d'urgence ni encore que ses vendeurs aient manifesté leur intention claire de ne pas exécuter leur obligation, ce qui l'aurait dispensé de la mise en demeure, tel que le prévoit l'
article 1597 C.c.Q. : " Art. 1597 . Le débiteur est en demeure de plein droit, par le seul effet de la loi, lorsque l'obligation ne pouvait être exécutée utilement que dans un certain temps qu'il a laissé s'écouler ou qu'il ne l'a pas exécutée immédiatement alors qu'il y avait urgence.
Il est également en demeure de plein droit lorsqu'il a manqué à une obligation de ne pas faire, ou qu'il a, par sa faute, rendu impossible l'exécution en nature de l'obligation; il l'est encore lorsqu'il a clairement manifesté au créancier son intention de ne pas exécuter l'obligation ou, s'il s'agit d'une obligation à exécution successive, qu'il refuse ou néglige de l'exécuter de manière répétée." [23] Le Tribunal ne peut donc faire droit à cette réclamation. » [ 16 ] WHEREAS plaintiff’s husband stated that he tried to notify Péladeau verbally and that Péladeau did not respond, but this is denied by defendant; [ 17 ] WHEREAS in Chantal Vézina c.
Daniel Deslauriers , [3] the honourable Micheline Laliberté stated: « [6] CONSIDÉRANT que la preuve documentaire révèle que la mise en demeure fut postée le 1er février 2001, soit après que tous les travaux eurent été exécutés en octobre et décembre 2000, ce qui est contraire à l'
article 1595 du Code Civil du Québec : "La demande extrajudiciaire par laquelle le créancier met son débiteur en demeure doit être faite par écrit. Elle doit accorder au débiteur un délai d'exécution suffisant , eu égard à la nature de l'obligation et aux circonstances; autrement, le débiteur peut toujours l'exécuter dans un délai raisonnable à compter de la demande" (nos soulignements); [7] CONSIDÉRANT qu'en l'espèce, la requérante a omis d'expédier une mise en demeure écrite à la
partie intimée avant de faire procéder aux réparations dont elle réclame le coût, ce qui constitue une fin de non-recevoir à la réclamation; [8] CONSIDÉRANT que la requérante n'a pas prouvé que la
partie intimée avait clairement manifesté son intention de ne pas
réparer son automobile, monsieur Deslauriers ayant d'ailleurs témoigné que s'il avait été avisé en temps utile, il aurait pu procéder à un nouvel examen ou à de nouvelles réparations, ou à un retour de la pièce chez le fabriquant; » [ 18 ] WHEREAS plaintiff’s allegation of urgency is unsubstantiated; [ 19 ] WHEREAS , furthermore, plaintiff did not prove, by a preponderance of evidence ( sections 2803 and 2804 of the Civil Code of Québec ), that the ʺthermopompeʺ alluded to repeatedly in inspection report P-5, did not constitute a ʺcentral heat pumpʺ; [ 20 ] WHEREAS Climatisation Fraser’s invoice also states that it replaced (vs installed) a ʺthermopompeʺ; [ 21 ] WHEREAS the English translation of ʺthermopompeʺ is ʺheat pumpʺ (Harrap’s Shorter French and English Dictionary, 1991 edition); [ 22 ] WHEREAS , what is more, if this were indeed the case, it would have constituted an apparent defect and not a latent defect (section 1726 C.C.Q .); [ 23 ] WHEREAS , furthermore, even if the above were not the case, the ʺthermopompeʺ was approximately 13 years old, and plaintiff would not have been entitled to the cost of a new unit, as the Court would have to take depreciation into account; [ 24 ] WHEREAS there is no preponderant evidence that Péladeau or Montanaro committed a fault or acted in bad faith; [ 25 ] WHEREAS , finally, there is no lien de droit between plaintiff and defendant 4429419 Canada Inc., the latter having had no implication whatsoever in the sale of the property; WHEREFORE THE COURT HEREBY: DISMISSES plaintiff's application, with legal costs. __________________________________ ELIANA MARENGO, J.C.Q.
