Any person who contravenes this provision commits an offence and is liable to a fine. (Sections 9.2, 9.3 and 135 Y.P.A .) APERÇU [ 1 ] La situation de l’adolescent est signalée au mois de mars 2022 en raison de ses troubles de comportement sérieux ainsi qu’en lien avec la négligence sur le plan physique et éducatif de la part de sa mère. [ 2 ] La mère est monoparentale et doit veiller aux besoins de l’adolescent et de sa sœur cadette. Elle est dépassée par les crises et l’agressivité de l’adolescent et n’arrive pas à mettre en place des limites et une structure appropriée à ses besoins.
La mère n’a aucune autorité à l’endroit de son fils et subit beaucoup de violence de sa part. [ 3 ] À la suite d’une intervention policière en date du 2 août au domicile familial en raison de la violence de l’adolescent à l’endroit de sa mère et des objets, ce dernier est placé en centre de réadaptation.
Notons que plusieurs interventions policières ont eu lieu dans les derniers mois en lien avec l’agressivité dont fait preuve l’adolescent. [ 4 ] L’adolescent reconnaît ses comportements difficiles : crises et agressivité dirigées envers sa mère et les objets, consommation et fréquentations à risque. [ 5 ] L’adolescent évolue positivement au foyer de groupe. Il accepte d’y demeurer pour une période de dix mois. Cette période lui permettra de terminer son année scolaire et de réintégrer progressivement le domicile familial pendant la période estivale. [ 6 ] La mère reconnaît la situation de compromission.
Elle craint toutefois que la période de placement demandée ait un impact sur sa relation avec son fils. Elle souhaiterait une période de placement plus courte. ANALYSE DE LA PREUVE ET DÉCISION [ 7 ] Le Tribunal reprend ci-dessous certaines allégations de la demande en protection qui sont admises par l’adolescent et sa mère : • The father passed away approximately two years ago; • The home environment is unsanitary and cluttered;
• Serious concerns exist that the mother has hoarding issues; • This has been a chronic issue for the family; • The mother has been unable to mobilize herself to address the issues in the home; • The mother is struggling financially and expresses being overwhelmed; • Concerns exist with regards to the mother’s mental health; • The mother does not take accountability for the unacceptable home environment; • The mother and the adolescent have a conflictual relationship; • The adolescent and the mother regularly have conflicts that escalate; • During these conflicts, the adolescent can become verbally abusive towards his mother, he can throw items and destroy items in the home and can also be physically aggressive with his mother; • Police intervention has been necessary on at least three occasions due to the adolescent out of control behaviour; • On or around August 1, 2022, the conflict between the mother and the adolescent escalated and police intervention was required; • On said occasion, the adolescent was placed in a group home and a 30-day provisional placement agreement was signed for him to remain there; • The adolescent regularly consumes marijuana; • The adolescent associate with negative peers; • The adolescent does not inform his mother of his whereabouts while in the community; • Concerns exist with regards to the adolescent’s mental health as he has engaged in suicidal ideations; • The mother is overwhelmed by the adolescent’s behaviours; • The mother has difficulties imposing boundaries and consequences to the adolescent; • The mother is often unaware of the adolescent whereabouts in the community; • The mother is unaware of the adolescent peers; • Concerns exist that the adolescent is associating with negative peers as the adolescent has been found to have weapons on him, which he deems are for his protection. [ 8 ] Depuis le placement de l’adolescent, la relation entre ce dernier et sa mère demeure très tendue.
On remarque lors de la première rencontre supervisée que l’adolescent adopte une attitude condescendante et empreinte d’irrespect envers sa mère. Il lui dicte comment elle doit agir et se montre contrôlant envers elle. Les rôles semblent inversés. [ 9 ] La mère doit reprendre le rôle qui lui revient. Le Tribunal constate que le travail relationnel entre l’adolescent et sa mère est important. Pour l’instant, l’adolescent refuse les contacts proposés auprès de sa mère. Il semble avoir en lui beaucoup de colère et de reproches.
Il sera important de supporter mère et fils dans la reprise d’une relation de confiance saine et leur permettre d’exprimer de manière appropriée leurs sentiments et attentes l’un envers l’autre. [ 10 ] La mère doit aussi prendre le temps de réorganiser son environnement physique. Depuis plusieurs mois, on constate que cette dernière est incapable de répondre aux besoins physiques de son fils. Il semble que l’adolescent soit en réaction en lien avec ses conditions de vie et il le nomme ouvertement.
Par contre, ceci ne saurait en aucun temps excuser les propos et attitudes irrespectueuses de l’adolescente envers sa mère. [ 11 ] L’adolescent a beaucoup de travail à faire en ce qui concerne le respect du cadre et de l’autorité. En effet, on constate en milieu scolaire ainsi qu’en milieu d’accueil que l’adolescent peine à respecter les limites et les règles mises en place.
Le respect de l’autorité est un enjeu pour l’adolescent. [ 12 ] Considérant les difficultés encore bien présentes et le travail à effectuer auprès de la famille, le Tribunal constate que la période de placement est raisonnable et nécessaire pour atteindre les objectifs visés. THEREFORE, THE COURT: [ 13 ] GRANTS the Application; [ 14 ] DECLARES that the security and development of the adolescent, X , are compromised in conformity with
section 38 b) 1 i, b) 1 iii and
f) of the Youth Protection Act ; AND ORDERS THE FOLLOWING MEASURES: [ 15 ] ENTRUSTS the adolescent to a rehabilitation center;
[ 16 ] TAKES ACT that the adolescent is residing at Group Home A; [ 17 ] ORDERS that the frequency and modalities of contacts between the mother and the adolescent be determined by the Director of Youth Protection, including supervision if deemed necessary; [ 18 ] TAKES JUDICIAL NOTICE that the contacts between the adolescent and his mother will be encouraged by the Director of Youth Protection; [ 19 ] ORDERS that the adolescent refrain from any form of verbal or physical violence; [ 20 ] ORDERS that the mother ensure that home environment is safe and sanitary for the adolescent; [ 21 ] TAKES JUDICIAL NOTICE that the Director of Youth Protection will make unannounced home visits in order to verify the state of the home environment; [ 22 ] ORDERS that the mother and the adolescent collaborate with the services of an educator if deemed necessary by the Director of Youth Protection; [ 23 ] TAKES ACT that it is the intention of the Director of Youth Protection to provide the services of an educator; [ 24 ] STRONGLY RECOMMENDS that the mother and the adolescent seek help to work on their communication; [ 25 ] ORDERS that a person working for the Centre Ingégré Universitaire de Santé et de Services Sociaux A to provide aid, counsel and assistance to the adolescent and the family; [ 26 ] THE WHOLE for a period of ten months; [ 27 ] ORDERS the transcription of the present judgment in English; [ 28 ] ENTRUSTS the situation of the adolescent, X , to the Director of Youth Protection of the Centre Intégré Universitaire de Santé et de Services Sociaux A, who shall then see that the measures are carried out.
