Counsel at hearing: For the appellant: Angèle C. Normand For the respondent: Derek J. Weaver THE COURT The application for leave to appeal sentence is dismissed . Avocats à l’audience : Pour l’appelant : Angèle C. Normand Pour l’intimée : Derek J. Weaver The following is the judgment delivered by THE COURT [ 1 ] G.L.C. is 82 years old. On February 5, 2013, he pled guilty to nine counts alleging sexual offences committed against four different young girls between 1974 and 1988.
The offences ranged in nature from fondling to unprotected sexual intercourse and their duration extended over long periods: 16 years in the case of one victim, who was his step- daughter; and, in the case of the others who were friends of his step-daughter, six, five and one year(
s) respectively. The offences were the result of his planned and deliberate actions for his sexual gratification and were committed with reckless abandon as to the long-term and devastating effects on the victims.
Violations of trust and even force featured in the perpetration of some of the offences. [ 2 ] Upon considering the seriousness of the offences, and giving due consideration to G.L.C.’s cooperation with the police investigation, his guilty pleas, his expression of remorse, the absence of a criminal record at the time the offences were committed, and his age and health, a judge of the Provincial Court settled upon a sentence of imprisonment totalling 12 years and made a number of ancillary orders. [ 3 ] G.L.C. seeks leave to appeal the sentence.
In our view, none of the grounds he wishes to advance would justify appellate intervention. His application for leave to appeal is therefore dismissed. ______________________________ J.C. MARC RICHARD, J.A. ______________________________ B. RICHARD BELL, J.A
