Mtre MASSIMO DE SIMONE FONDS D’ASSURANCE RESPONSABILITÉ PROFESSIONNELLE DU BARREAU DU QUÉBEC RESPONDENTS - Defendants JUDGMENT [ 1 ] The Respondents are seeking the dismissal of the appeal on the basis of article 501 (4.1) C.C.P., alleging that the appeal has no reasonable chance of success. [ 2 ] In her inscription in appeal, the Appellant raises errors of fact on the part of the trial judge, whom she blames, amongst other things, of having preferred Respondent De Simone’s testimony to her own. [ 3 ] Her appeal is an attempt to retry the case which is not the role of this Court. [ 4 ] In our opinion, the appeal stands no reasonable chance of success.
