Counsel at hearing: For the appellant: Cameron H. Gunn For the respondent: Margaret Gallagher Avocats à l’audience : Pour l’appelante : Cameron H. Gunn Pour l’intimé : Margaret Gallagher THE COURT The application for leave to appeal the conviction, the motion to withdraw a guilty plea, and the appeal from conviction are allowed. The Attorney General’s sentence appeal is dismissed as moot.
The following is the judgment delivered by THE COURT (Orally) [ 1 ] On January 20, 2012, Kevin Ambrose Robinson pled guilty to impaired driving causing bodily harm ( s. 255(2) of the Criminal Code ), and on March 8, 2012, he was sentenced to 15 months imprisonment to be served in the community. Mr. Robinson seeks leave to appeal the conviction and asks to withdraw his guilty plea. Meanwhile, the Attorney General of New Brunswick seeks leave to appeal the sentence.
However, the Attorney General consents to the withdrawal of the guilty plea on the recognition that both defence counsel and the prosecutor mistakenly misled Mr. Robinson about the consequences of his plea. Considering the Attorney General’s consent, we would therefore grant Mr. Robinson leave to appeal his conviction, allow his motion to withdraw the guilty plea, allow his appeal, and order a new trial. It follows that the Attorney General’s application for leave to appeal sentence becomes moot and, for this reason, it is dismissed. ________________________________ J.C.
