N o : 525-41-023411-101 DATE : 22 janvier 2013 ______________________________________________________________________ SOUS LA PRÉSIDENCE DE : L’HONORABLE JUGE LUCIE GODIN, J.C.Q. ______________________________________________________________________ Dans la situation de l'enfant : X né […] 2007 [INTERVENANTE 1] , personne autorisée par la Directrice de la protection de la jeunesse La personne déclarante -et- A -et- B Les parents mis en cause ______________________________________________________________________ JUGEMENT ______________________________________________________________________ [ 1 ] À la demande et du consentement de toutes les parties, le Tribunal procède à une enquête commune dans la situation des enfants Y, Z et X. [ 2 ] Le Tribunal est saisi d'une requête en prolongation d'une ordonnance prononcée le 7 février 2012 dans laquelle il ordonnait que l’enfant soit confié à sa grand-mère maternelle pour une période de six (6) mois et un suivi social pour une période d’une (1) année, de même que certaines autres mesures visant à corriger la situation. [ 3 ] La Directrice allègue que la situation de l’enfant exige une prolongation d'ordonnance pour certains motifs. [ 4 ] En conséquence, la Directrice recommande au Tribunal de le confier à son père. [ 5 ] La mère est absente, bien que dûment informée.
Elle a été appelée, ne répond pas. [ 6 ] Pour les motifs indiqués au procès-verbal, le Tribunal procède en son absence. [ 7 ] Le père admet l’essentiel des faits allégués dans la requête. Il exprime son accord aux faits que l’enfant lui soit confié, mais le père exprime clairement qu’il ne voit pas de raison à la poursuite de l’intervention de la Directrice.
État de compromission [ 8 ] Tenant compte des admissions formulées par le père et de la preuve documentaire, le Tribunal conclut que la sécurité et le développement de l’enfant sont compromis pour les motifs allégués. [ 9 ] Le Tribunal retient les éléments suivants : - - the parents continue to have a conflictual relationship and this has had a negative impact on the child, - the father continues to have anger management issues and at times becomes extremely temperamental, - the child X re-integrated his father’s home as per the court order, - the relationship between the father and the maternal grandmother has at times remained tense and conflictual,
- the father reports that the maternal grandmother may have issues around alcohol use but the latter has denied this information, - information is to the effect that the father has at times left the child alone without adequate adult supervision, - the child has also reported that the father at times uses physical discipline when he misbehaves, - the mother reports having concerns around the father’s living environment, namely, that activities such as gambling and drinking occur while the child is present, - both parents at times denigrate each other in front of the child, - the mother has continued to experience residential instability, having moved twice since the last court order, - the mother entered into a new relationship with a man who has in fact been violent towards her, - the mother has found employment and has completed a business course, - the mother has still not taken the steps to address her mental health issues, - the father continues to need to improve his home environment with respect to organization and structure, - the mother is still not in a position to resume caring for the child on a full-time basis.
Mesures [ 10 ] Dans son rapport déposé sous la cote D-1 [1] , l’intervenante sociale analyse ainsi la situation : « Overall, there have been many significant changes in the children’s lives. Z and Y were living with their father; X was living with the grandmother and was then re-integrated back in father’s care. Presently Y is living with grandmother and the father is hoping he will eventually come back in into his care. The Children are much safer and have more consistent routines in father’s home. The support of mother and grandmother who are very committed to the children is invaluable.
Z and X are with their father and appear happy. Surprisingly, Y appears settled and happy in grandmother’s home and is seeing more of his mother who comes to visit him often. Mother has made a turn around and is taking better care o herself and as a result, she is able to better extend herself to her children. All three (3) children very much enjoy the weekends spent with their grandmother.
There are questions about Y’s reaction if he were to return to his father’s care such as will he display the same problems, are his needs better met by the grandmother and is it possible that having three (3) children under the father’s roof? These questions need to be further assessed. There are still things that need to change to ensure that the children continue to be safe, taken care of and well-nurtured. The conflictual relationship between mother and father continues to dominate the scene. Mr. B’s volatile temper makes it difficult to intervene as he becomes defensive. At other times he is very workable.
There are issues regarding father’s living environment (the home needs better organization and structure) and a need for him to be more conscious of basic health and medical care of the children. The children Z and Y, have special needs as they have academic difficulties and behavior problems. They require skills and special interventions which an educator could be helpful but father is not open to it. There are also reports of using physical discipline when the children become unmanageable. However, he has opted for parenting classes and let us hope that it will prove useful for him.
As well, he will continuously need the support of the grandmother and extended family members, which at this time, is provided only by the maternal family. In order to raise the children well, it is necessary for him to collaborate with them. It does not help for him to be at odds with them. It is essential to establish whether father’s accusations concerning grandmother’s drinking and the maternal family’s accusations regarding father’s gambling issues are founded or just frivolous allegations made in an attempt to fight over the children’s custody.
Only time would tell. » [ 11 ] Avant de formuler ses recommandations, l’intervenante sociale prend en compte les éléments suivants [2] : - their basic needs are met, including physical/medical, dental and important appointments, - they are safe, secure and well-nurtured, - they are provided with consistent adult supervision, - the children’s behaviours are managed using alternative techniques rather than physical discipline, - the parents are able to control their impulses and personal differences in the presence of the children and respect each other’s boundaries, visitations and rights as spelled out in superior court orders, - the parents know how to access community resources to meet the family’s needs; [ 12 ] Tenant compte de l’ensemble de la situation, des objectifs visés par l’intervention, le Tribunal conclut que les recommandations sont dans l’intérêt de l’enfant; [ 13 ] PAR CES MOTIFS, LE TRIBUNAL : [ 14 ] ORDERS that X be entrusted to his father; [ 15 ] ORDERS that the frequency and modality of contacts between mother and the child be determined by DYP including supervision as long as deemed necessary;
[ 16 ] ORDERS that the parents ensure that the child is not exposed to any violence, verbal or physical; [ 17 ] RECOMMANDS that the father continues to participate in a parental skills activity; [ 18 ] RECOMMANDS that mother follows the recommendation of the parental capacity assessment made on May 20 th , 2011; [ 19 ] AUTHORIZED DYP to receive information of professionals with regards to the therapies participated by the family; [ 20 ] RECOMMANDS that the father continues to seek custody and the Court takes judicial notice that the hearing is fixed in Superior Court, January 25 th , 2013; [ 21 ] ORDERS that aid, counsel and assistance be provided for a period of six (6) months as of today; [ 22 ] ENTRUSTS the situation of the child to the DYP of A Youth and Family Centres, for the execution of the present order; [ 23 ] __________________________________ LUCIE GODIN, J.C.Q.
