Respondent and THE PUBLIC CURATOR OF QUEBEC Impleaded Party ORDER AUTHORIZING RESPONDENT’S CONFINEMENT [ 1 ] WHEREAS the psychiatric assessment reports filed as Exhibits P-3 and P-4 find that Respondent is currently a danger to herself or to others owing to /her mental state; [ 2 ] WHEREAS as a result of the foregoing, the psychiatric assessment reports filed as Exhibits P-3 and P-4 find that Respondent’s confinement is necessary to stave off said danger; [ 3 ] WHEREAS Respondent does not contest the reasons to agree to remain in Petitioner’s wards; [ 4 ] WHEREAS Respondent is a capable witness and was given the opportunity to offer testimony and submit his opinions before the Court; [ 5 ] WHEREAS the Court must consider sections 3 and 9 of an Act respecting the protection of persons whose mental state presents a danger to themselves or to others , CQLR c P-38.001,
section 30 of the Civil Code of Quebec and
section 391 of the Code of Civil Procedure to rule on the present issue; [ 6 ] WHEREAS the Court has substantial grounds to believe that Respondent is a danger to herself or to others owing to her mental state and that her confinement is therefore necessary; [ 7 ] WHEREAS the Court verbally expressed additional reasons at the time of Respondent’s hearing;
WHEREFORE, THE COURT: [ 8 ] ABRIDGE the delays for instituting confinement proceedings as provided by
section 396 C.C.P.; [ 9 ] GRANTS Petitioner’s application; [ 10 ] ORDERS Respondent’s confinement to one of Petitioner’s wards for a duration not exceeding 21 days; [ 11 ] THE WHOLE without costs. _____________________________ MADELEINE AUBÉ, J.C.Q. (JA0957)
