Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). ______________________________________________________________________ [ 1 ] The present judgment confirms in writing the decision rendered orally at the hearing held on April 12, 2019. [ 2 ] La Directrice de la protection de la jeunesse (la Directrice) demande au Tribunal de prolonger son ordonnance rendue le 25 mai 2018. [ 3 ] Plus spécifiquement, elle demande de confier X (2 ans) chez sa tante maternelle, madame C et qu’un suivi social soit offert à la famille pour une période de neuf (9) mois. [ 4 ] L’enfant, par la voix de son avocat, est en accord avec les mesures proposées. [ 5 ] Les parents sont absents lors de l’audition.

CONTEXTE ET ANALYSE [ 6 ] La sécurité et le développement de l’enfant sont déclarés toujours compromis le 25 mai 2018. L’enfant est depuis confié à sa tante maternelle. [ 7 ] Depuis la dernière audition, un projet de vie pour l’enfant se dessine. Les démarches sont entamées afin que la tante maternelle soit déclarée tutrice de l’enfant. Elle maintient vouloir rester impliquée dans la vie de l’enfant à long terme.

[ 8 ] Les démarches n’ont pas pu être complétées avant la fin de la dernière ordonnance, toutefois, la tante est toujours en accord avec ce plan. [ 9 ] L’enfant évolue bien auprès de sa tante et demeure en contact avec sa fratrie. [ 10 ] Un lien significatif les unit. La tante a complété les démarches afin que l’enfant ait sa carte d’identification [...]. [ 11 ] La situation des parents est toujours au statu quo .

Ils ne sont pratiquement pas impliqués dans la vie de l’enfant, ni dans le suivi social. [ 12 ] Un délai est requis afin de finaliser le projet de vie de l’enfant. [ 13 ] Le Tribunal estime que les mesures proposées sont dans le meilleur intérêt et le respect des droits de l’enfant. CONSEQUENTLY, AND FOR THESE REASONS, THE COURT: [ 14 ] GRANTS the Application; [ 15 ] DECLARES that the security and development of the child continue to be endangered within the meaning of the Youth Protection Act ; AND IN VIRTUE OF THE POWERS CONFERRED UPON THE COURT BY

SECTION 91 OF THE YOUTH PROTECTION ACT: [ 16 ] ORDERS that the child be entrusted to the foster home of the maternal aunt, Ms. C; [ 17 ] ORDERS that the frequency and modality of contacts between the child and his mother be determined by the Director of Youth Protection, including supervision, taking note that Ms.

C is authorized to supervise such contacts; [ 18 ] SUSPENDS contacts between the child and his father, until he demonstrates genuine motivation to become involved in the child’s life and should contacts between the child and his father resume, ORDERS that frequency and modality of contacts between the child and his father be determined by the Director of Youth Protection; [ 19 ] WITHDRAWS from the parents the attributes of their parental authority in regards to signing consents for the child (re: travel, medical and social needs, [...] and applying for passport); [ 20 ] AUTHORIZES Ms.

C to be authorized to sign consents for the child (re: travel, medical and social needs, [...] and applying for passport); [ 21 ] RECOMMENDS that the parents refrain from being under the influence of all substances in the presence of the child; [ 22 ] RECOMMENDS for the parents to address their personal issues and report back to Director of Youth Protection as to their progress; [ 23 ] ORDERS that the parents inform the Director of Youth Protection of any change of address or telephone number; [ 24 ] AUTHORIZES the Director of Youth Protection to receive and obtain information from the treating professionals for the child; [ 25 ] ORDERS that an extract of judgment be sent by the court clerk to the maternal aunt, Ms.

C, in regards to the exercises of the attributes of the parental authority; [ 26 ] ORDERS that aid, counsel and assistance be provided to the child and his family; [ 27 ] ENTRUSTS the situation of the child, X, to the Director of Youth Protection of the Centre intégré universitaire de santé et services sociaux (CIUSSS) A, who shall then see that the measures are carried out; [ 28 ] ORDERS the execution of the present judgment by any peace officer if necessary; [ 29 ] THE WHOLE for a period of nine (9) months.
