Robert Osadchuck, Clerk at the hearing JUDGMENT Moyen préliminaire : [ 1 ] La Cour, exerçant ses pouvoirs de gestion, a compétence pour devancer l’audition d’une requête, et ce, nonobstant que cette requête a été déférée à une autre formation par le juge unique. [ 2 ] La chose jugée ne s’applique pas à ces mesures de gestion.
POUR CES MOTIFS, LA COUR : [ 3 ] REJETTE le moyen préliminaire, avec les frais de justice. “Requête pour permission d’appeler d’un jugement rendu par la Cour supérieure de bene esse ” and Application to dismiss the appeal: [ 4 ] The Appellant obtained a judgment from the Superior Court on March 19, 2020, currently under appeal, that condemns the estate of the deceased. Albert Douek, to pay her $700,000. [1] To secure that judgment, she published a legal hypothec against an undivided one-half interest in an immoveable property under
Article 2730 C.c.Q. [ 5 ] The immoveable property belongs to the estate of the deceased’s wife. The deceased was never a co-owner. If the property formed part of the family patrimony, as alleged by the Appellant, the deceased (and thus, his estate) would have a claim in personam
against the wife’s estate for one-half of the net value of the family patrimony, but no right of ownership in the immoveable property. [2] [ 6 ] As such, Poulin J.S.C., was correct to order the radiation of the legal hypothec in her judgment of December 23, 2020. The appeal is clearly unfounded and has no reasonable chance of success.
FOR THE FOREGOING REASONS, THE COURT: [ 7 ] DISMISSES the “requête pour permission d’appeler d’un jugement rendu par la Cour supérieure de bene esse ” with legal costs; [ 8 ] GRANTS the application to dismiss an appeal of February 16, 2021 with legal costs; [ 9 ] DISMISSES the appeal, with legal costs.
