Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] The child was entrusted to a maternal aunt when he was a few months-old. The aunt has been taking very good care of him ever since. There is a strong bond between them. [ 2 ] Neither the mother nor the father assume their parental duties in regard to the child. The mother has contact with the child but they are not on a regular basis. The proposed tutor is able to manage those contact, as she already does.

The father is absent from the child’s life. [ 3 ] The child is developing well and he does not need youth protection services anymore. [ 4 ] The application meets the child’s best interest. FOR THESE REASONS AND THOSE EXPRESSED ORALLY AT THE HEARING, THE COURT: [ 5 ] GRANTS the application; [ 6 ] APPOINTS Ms. C as a tutor for the child X; [ 7 ] ENTRUSTS the child X to Ms. C; [ 8 ] THE WHOLE without costs.
