In the situation of : X , born […] 2006 [SOCIAL WORKER 1] , PETITIONER and A , RESPONDENT MOTHER and B , PROPOSED TUTOR and LE CURATEUR PUBLIC DU QUÉBEC , IMPLICATED PARTY JUDGMENT WARNING : Court records relating to the adoption of a child are confidential and no identifying information about the child , his parents, guardian or adoptive parents may be published or distributed , except to comply with the law (article . 815.4 CPC and 582 CCQ) . [ 1 ] The applicant is requesting the court to appoint Mr.B guardian to the child X , born […], 2006 . [ 2 ] At the hearing, the mother is absent.
The child is represented by a lawyer, which agrees with the conclusions of the motion, while it consents to the filing of psychosocial report prepared by [Social Worker 2] . [ 3 ] X has eight years old. On october 21, 2008, Mr Justice Whittom, J.C.Q., granted a petition for protection ordering X to be entrusted to a foster family until her majority. The child has a normal development. [ 4 ] Mrs A, the mother, agrees with the petition.
She told at Mrs [Social Worker 2] as she understands that X is in a stable environment. [ 5 ] Since the placement of X on July 1 st , 2007, the mother has never assumed parental responsabilities. In fact, the mother has not shown any interest for her child. She have a lot of personnal difficulties, particularly with alcool and drug. [ 6 ] X lives with Mr B and Mrs C, his spouse, since 2007. He testifies that the child feels good with them and all the family. It
seems important to say that X brother, Y lives with them. [ 7 ] Mr B is implicated in his community and he's ready to keep X for long term. Also, he agrees with the tutorship of X. [ 8 ] Mr B demonstrates a real interest toward the child and he has the skills to give her all that she needs. [ 9 ] Considering the whole evidence, it is in X best interest to benefit from the permanent life project of tutorship. [ 10 ] FOR THESE REASONS, THE COURT : [ 11 ] GRANTS the motion; [ 12 ] APPOINTS Mr B as tutor for the child X; [ 13 ] ENTRUSTS the child X to Mr.
B; [ 14 ] ORDERS to the Youth Protection Delegate to keep the youth protection's file of X until she reaches her majority; [ 15 ] WITHOUT COSTS . __________________________________ DENIS PARADIS, J.C.Q.
