Loi sur la protection de la jeunesse ) ______________________________________________________________________ MISE EN GARDE : La
Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d’identifier un enfant ou ses parents. Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). [ 1 ] Le Tribunal est saisi d’une demande en prolongation, au sens de l’article 95 de la
Loi sur la protection de la jeunesse , relativement à X, née le [...] 2008, et à Y, née le [...] 2011. [ 2 ] Les parents sont présents lors de l’audience, assistés de leur avocat respectif. Les enfants sont représentées. [ 3 ] Tel que l’autorise l’article 76.3 de la
Loi sur la protection de la jeunesse, les parties déposent un projet d’entente.
Elles y reconnaissent les faits démontrant que la sécurité et que le développement des enfants sont toujours compromis et admettent que la situation de ces dernières exige une prolongation de la décision du 7 juin 2016; elles y précisent aussi les mesures visant à mettre fin à cette situation. [ 4 ] Constatant que la sécurité et que le développement des enfants demeurent toujours compromis et que les mesures proposées, auxquelles les parties consentent de façon libre et éclairée, respectent les droits et l’intérêt des enfants, le Tribunal entérine l’entente et ordonne l’exécution des mesures qui y sont convenues. [ 5 ] POUR CES MOTIFS, LE TRIBUNAL : [ 6 ] ACCUEILLE la demande; [ 7 ] DÉCLARE la sécurité et le développement des enfants toujours compromis;
[ 8 ] ENTÉRINE ET DÉCLARE EXÉCUTOIRE l’entente sur les mesures applicables ci-annexées; [ 9 ] ORDONNE L’EXÉCUTION DES MESURES SUIVANTES :
a) That the children be maintained under the care of their parents according to the Superior Court Judgment rendered on May 29th, 2015 by the Honourable Suzanne Tessier;
b) That the mother take an active
part in the application of the measures to put an end to the situation in which the security or development of the children is in danger notably :
i) That she continue her therapy with Ottawa Capital Counselling concerning her usage of Methadone and/or Suboxone and her follow up with Dr Mark Ujjainwalla; ii) That she give a person authorized by the Director of Youth Protection authorization to communicate with Ottawa Capital Counselling to verify her assiduity and her progress; iii) That the mother do urine tests upon agreement with a person authorized by the Director of Youth Protection;
c) That the parents collaborate to the social follow up, notably to the intervention plan;

______________________________________________________________________ [SOCIAL WORKER 1] FOR THE DIRECTOR OF YOUTH PROTECTION A Applicant and X Y Children and A B In their capacity as parents ______________________________________________________________________ JUDGMENT (section 95, Youth Protection Act ) ______________________________________________________________________ WARNING : The Youth Protection Act prohibits the publication or broadcast of information allowing a child or the child’s parents to be identified.
Every person who contravenes this provision is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [1] The Court is seized of an application for extension, within the meaning of
section 95 of the Youth Protection Act , concerning X, born on [...], 2008, and Y, born on [...], 2011. [2] The parents, who were assisted by their respective attorneys, attended the hearing. The children were represented. [3] As authorized by
section 76.3 of the Youth Protection Act , the parties submitted a draft agreement.
In it, they acknowledge the facts showing that the security and development of the children are still in danger, and admit that the children’s situation requires an extension of the June 7, 2016 decision ; they also specify the measures to put an end to the situation. [4] After establishing that the security and development of the children are still in danger and that the measures proposed, to which the parties consented in a free and enlightened manner, respect the rights and interest of the children, the Court confirms the agreement and orders the implementation of the measures agreed to therein. [5] THEREFORE, THE COURT : [6] ALLOWS the application; [7] DECLARES that the security and development of the children are still in danger; [8] CONFIRMS AND DECLARES EXECUTORY the agreement on the applicable measures attached hereto; [9] ORDERS THE IMPLEMENTATION OF THE FOLLOWING MEASURES: [The following passage appears in English in the original French-language judgment.]
