Section 95 Y.P.A. ______________________________________________________________________ WARNING : The Youth Protection Act, forbids the publishing or broadcasting of information allowing for a child or the child's parents to be identified.
Any person who contravenes this provision commits an offence and is liable to a fine. (Sections 11.2, 11.2.1 and 135 Y.P.A .) APERÇU [ 1 ] Comme les parents n’ont entrepris aucune démarche pour remédier aux motifs de compromission et qu’ils se sont désinvestis de la vie de leur fils, la Directrice demande au Tribunal de prolonger le placement de l’enfant pour une période de neuf mois. Cette période permettra à la Directrice de mettre en place un projet de vie permanent pour l’enfant. [ 2 ] Les parents sont absents.
Ils ont été dûment notifiés de la demande en protection et avisés de la date de présentation de ladite demande. Le Tribunal a procédé en leur absence. [ 3 ] L’enfant est dûment représenté. Son procureur est d’avis que les mesures proposées par la Directrice répondent à ses besoins ainsi qu’à son meilleur intérêt.
CONTEXTE ET ANALYSE [ 4 ] Au soutien de sa demande en protection, la Directrice allègue les faits suivants: • The child has remained in the same foster home, where he is doing well; • The child has been receiving the required medical follow-up, and there are no significant medical issues at this time; • The youth protection worker has attempted to arrange two visits per week between the mother and the child, however the mother is inconsistent in returning calls to
schedule the visits, and on several occasions she did not show up to scheduled visits; • In December 2019, the mother did not present herself to a scheduled visit, as the maternal grandmother was unwilling to transport her as she observed the mother to be under the influence;
• In December 2019, the youth protection worker called the father to set up a meeting, and the father denied that he was the child’s father and did not ask to see the child; • In March 2020, the father reached out to the youth protection worker and asked that he be able to have visits with the child; • Visits between the child and the parents were suspended during the COVID-19 pandemic; • In May 2020, visits between the child and the parents resumed; • On May 29, 2020, the parents called to say they would be a few minutes late to the visit, over thirty minutes later the parents had still not showed up, and therefore the visit had to be cancelled; • On June 5 and June 10,2020, the parents did not show up to their scheduled visits with the child, and never contacted the youth protection worker to cancel or reschedule; • Since June 10, 2020, the youth protection worker has been unable to reach the parents; • The transport to the visits is destabilizing for the child, and he cries the entire time; • The parents refuse to present themselves to the drug tests when requested to do so by the youth protection worker; • The mother has not addressed her mental health issues, or received anger management services; • The father has not addressed his substance abuse issues. [ 5 ] Le dernier contact que l’enfant a eu avec ses parents remonte au mois de juin 2020. [ 6 ] L’absence répétée des parents aux contacts amène la Directrice à changer de stratégie.
Si les parents veulent avoir des visites avec leur fils, ils doivent en faire la demande. Depuis, les parents n’ont formulé aucune demande de visite. Ils ne communiquent pas avec la famille d’accueil ou avec la Directrice pour prendre des nouvelles de l’évolution de leur fils. [ 7 ] La grand-mère maternelle ainsi que la grand-tante de l’enfant demeurent très impliquées auprès de ce dernier. [ 8 ]
Malgré leur volonté d’entreprendre des démarches pour régler leur difficulté, les parents n’y sont pas arrivés. Leur mode de vie demeure caractérisé par l’instabilité et la consommation. [ 9 ] L’enfant est placé depuis sa naissance en raison de leur historique de consommation et d’instabilité. [ 10 ] L’enfant, maintenant âgé d’un an, est en droit de grandir et d’évoluer dans un milieu de vie stable et prévisible. Une famille d’accueil a été identifiée pour répondre à ses besoins sur une base permanente.
Le temps presse, car cet enfant s’est attaché à sa famille d’accueil actuelle et vivra nécessairement un préjudice à la suite de cette séparation. [ 11 ] Considérant l’absence d’évolution des parents, le Tribunal est d’avis que la sécurité et le développement de l’enfant se trouvent toujours compromis et que les mesures préconisées par la Directrice répondent au meilleur intérêt de l’enfant ainsi qu’à ses besoins.
THEREFORE, THE COURT: [ 12 ] GRANTS the Application; [ 13 ] DECLARES that the security and the development of the child continues to be in danger; AND ORDERS THE FOLLOWING MEASURES: [ 14 ] ORDERS that the child remain entrusted to a confidential foster home; [ 15 ] SUSPENDS the contacts between the child and his parents until they each meet with the delegate at least on three occasions to demonstrate their commitment to having contacts and stability of their situation, should contacts resumed ORDERS that those contacts be determined by the Director of Youth Protection concerning their frequency and modality, including supervision if deemed necessary; [ 16 ] AUTHORIZES the Director of Youth Protection to suspend contacts with either parent should they demonstrate a inconsistency in attending or be deemed a risk for the child, until they meet with the worker to demonstrate the stability and capacity to resume; [ 17 ] ORDERS that the parents refrain from being under the influence of any substance and that they submit to random drug and alcohol testing; [ 18 ] ORDERS that the frequency and modality of contacts between the child and his extended family be determined by the Director of Youth Protection; [ 19 ] STRONGLY RECOMMENDS that both parents seek services to address their personal issues and that they report periodically their progress to the Director of Youth Protection; [ 20 ] WITHDRAWS from the parents certain attributes of parental authority regarding medical, educational, therapeutic services, extra-curricular, recreational activities and travel and GRANTS those attributes to the Director of Youth Protection; [ 21 ] AUTHORIZES the Director of Youth Protection to exchange all relevant information with the treating professionals involved
with the family; [ 22 ] ORDERS that the parents collaborate with the Director of Youth Protection, including providing up to date contact information at all times; [ 23 ] ORDERS that a person working for a child and youth protection services provide aid, counsel and assistance to the child and his family; [ 24 ] THE WHOLE for a period of nine months; [ 25 ] ENTRUSTS the situation of the child, X , to the Director of Youth Protection of the Centre intégré universitaire de santé et de services sociaux A, who shall then see that the measures are carried out.
