Defendant ______________________________________________________________________ JUDGMENT (On plaintiff’s Rectification Application) ______________________________________________________________________ [ 1 ] I am seized with R. Maxine Collins’ application under
article 338 C.C.P . which seeks the correction of paragraphs 5, 8 and 12 in my reasons for judgment rendered on January 29, 2021. [ 2 ] The request for rectification of judgment is subject to strict, and well-defined conditions, as they emerge from
article 338 C.C.P. The applicant's request does not meet any of these conditions as the corrections requested could not be qualified as an error of writing or a clerical error. [ 3 ] Moreover, even if those paragraphs were corrected as requested by the applicant, those corrections would not alter the outcome of the judgment dismissing the applicants leave to appeal pursuant to
article 91 Act Respecting the Régie du Logement [1] . Accordingly, it is unnecessary to correct paragraphs 5, 8 and 12 of the judgment rendered on January 29, 2021 [2] . [ 4 ] I therefore dismiss, without a hearing and without legal costs, the Request for corrections to Decisions Issued January 29, 2021 .
