RICHARD BRIGINSHAW ANGELA BRIGINSHAW RESPONDENTS – Plaintiffs JUDGMENT [ 1 ] The applicants, defendants in first instance, seek leave to appeal the judgment dated August 18, 2023, rendered by the Honourable Dominique Goulet of the Superior Court, District of Gatineau. [ 2 ] That judgment granted the application filed in Superior Court by the plaintiffs in first instance (the respondents here on appeal) and (1) declared that the plaintiffs in first instance benefit from a servitude of right of way on a lot known as Pink Road, (2) ordered the defendants in first instance not to obstruct in any way Pink Road and the access by the plaintiffs in first instance to their property adjacent to that road, (3) ordered the defendants in first instance to remove any and all obstructions on that road, and (4) condemned the defendants in first instance to pay damages of $10,000 for defamation, $15,000 for loss of enjoyment, stress and inconvenience and $50,000 for abuse of procedure. [1] [ 3 ] The applicants, defendants in first instance, are of the view that leave to appeal is required as the trial judge declared their procedures and contestation abusive. [2] They have therefore sought leave to appeal the trial judgment.
The plaintiffs in first instance oppose the leave application, arguing that the proposed appeal has no reasonable chance of success and is abusive. [ 4 ] I conclude that I lack jurisdiction since the appeal may be initiated as of right. [ 5 ] The right to appeal a judgment of the Superior Court that terminates a proceeding is provided for in
article 30 of the Code of Civil Procedure (“ C.C.P. ”). As a rule, such judgments may be appealed as of right. However,
article 30 C.C.P. sets out a list of certain exceptions that require prior leave to appeal. One of these exceptions concerns “judgments dismissing a judicial application because of its abusive nature” ( « les jugements qui rejettent une demande en justice en raison de son caractère abusif » ). [ 6 ] The Court has determined that this exception applies to both originating applications and cross-applications that have been dismissed because of their abusive nature.
However, the exception does not require unsuccessful defendants to seek leave to appeal when their defence has been rejected, even though it has been found to be abusive. The governing case in this matter is Matte c.
Blais , [3] in which the Court concluded as follows: [4] [14] Or, la lecture de certaines dispositions du C.p.c . conduit inéluctablement à la conclusion que le législateur a voulu que seules les demandes introductives d’instance et les demandes reconventionnelles jugées abusives soient soumises à la nécessité d’obtenir une autorisation pour pouvoir interjeter appel du jugement qui les rejette. [15] Ainsi, le législateur intitule d’abord le
chapitre I du
titre I du livre II « la demande en justice » alors qu’il intitule le
chapitre II du même livre « l’assignation et la réponse du défendeur ». Alors que les dispositions qu’on retrouve au
chapitre I traitent essentiellement de ce qu’il est possible de réclamer du tribunal, et de la façon de le faire, le
chapitre II traite de la réponse du défendeur et de son contenu.
À l’évidence, le législateur, sous ce titre, distingue nettement la demande en justice de la réponse du défendeur, même si celle-ci vise le rejet du recours. [16] Il fait de même lorsqu’il accorde aux tribunaux le pouvoir de déclarer abusive une demande en justice ou un autre acte de procédure (art. 51 C.p.c .), de rejeter, dans un cas d’abus, la demande en justice ou un autre acte de procédure (art. 53 C.p.c .) et d’ordonner, en se prononçant sur le caractère abusif d’une demande en justice ou d’un autre acte de procédure , le remboursement de la provision versée pour les frais de l’instance (art. 54 C .p.c .). [17] Il n’impose d’ailleurs aux tribunaux l’obligation de rendre leurs jugements dans les deux mois de leur prise en délibéré (art.
324 C.p.c .) que lorsque ceux-ci décident du caractère abusif d’une demande en justice , et non pas de tout acte de procédure. [18] Bref, il accorde aux mots demande en justice une signification précise et limitée, qui permet de distinguer celle-ci des autres actes de procédure . [19] Dans ce contexte, la Cour ne peut que conclure qu’une lecture cohérente du C.p.c . conduit à la conclusion que le législateur ne vise pas tous les actes de procédure comportant une demande quelconque lorsqu’il réfère à une demande en justice à l’alinéa 2(3) de l’article 30 C.p.c . [20] Cela étant, la Cour est d’avis qu’une demande reconventionnelle est une demande en justice au sens de cet
article puisqu’il s’agit d’une réclamation que le défendeur fait valoir contre le demandeur. Le fait que cette demande soit exercée par voie reconventionnelle et qu’elle doive résulter de la même source que la demande principale n’en change pas la nature. D’ailleurs, la demande reconventionnelle est une instance en soi, dont le tribunal reste saisi malgré un désistement de la demande principale (art. 172 C.p.c .). [21] En l’espèce, les appelants bénéficient donc d’un droit d’appel de plein droit à l’encontre de la
partie du jugement qui rejette leur défense et accueille la requête introductive d’instance de Madame Blais , mais ils doivent obtenir une autorisation préalable s’ils veulent se pourvoir à l’encontre du jugement rejetant leur demande reconventionnelle qualifiée d’abusive. [Emphasis added] [ 7 ] This approach has subsequently been consistently followed. [5] [ 8 ] In this case, the applicants are not seeking to appeal the dismissal of a cross-application. Rather, they are appealing the judgment that rejected their defence and allowed the originating application of the plaintiffs in first instance.
Even though the defence was deemed abusive, the applicants are nevertheless entitled to appeal the judgment as of right. [ 9 ] As lack of subject-matter jurisdiction may be declared by a court on its own initiative, [6] I consequently declare myself without jurisdiction to either grant or dismiss the application for leave, because none is required . [ 10 ] In conclusion, as the applicants filed a notice of appeal on September 15, 2023, within the 30-day time limit set out in
article 360 C.C.P. , and since none of the exceptions of
article 30 C.C.P. requiring leave to appeal apply, the appeal has been properly initiated. [ 11 ] As the respondents have argued that the appeal has no reasonable chance of success and is abusive, they may, if they so which, seek to have the appeal dismissed on that basis by applying to a panel of this Court pursuant to
article 365 C.C.P . FOR THESE REASONS, THE UNDERSIGNED: [ 12 ] DECLARES that I am without jurisdiction to either grant or dismiss the application for leave to appeal as none is required in this case; [ 13 ] THE WHOLE without legal costs.
