THE DIRECTOR OF YOUTH PROTECTION Applicant and X Teenager and A Mother JUDGMENT WARNING: The Youth Protection Act forbids the publishing or broadcasting of information allowing for a child or the child’s parents to be identified.
Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] The Tribunal is seized of a request for protection in the situation of in regards to the teenager X (17 years old) . [ 2 ] On November 25 th 2020, the Youth Protection Director receive a report in regard of the teenager situation because she has serious risk of neglect and she has behavior disturbance. [ 3 ] On February 23 rd 2021, the Court orders an interim order and the teenager is entrusted to B. [ 4 ] For more than two years, the teenager lived with B and she received response to her needs . [ 5 ] The teenager has suicidal behavior and she needs to improve her self-esteem; [ 6 ] The mother still has addiction problems and she can’t take care of her daughter.
She also refuses or neglects to collaborate with the social worker. [ 7 ] X refused to attend the court hearing. The Court orders Me Chantal Gaudreau proprio motu to represent her interests. [ 8 ] The teenager’s social worker confirm that the teenager agrees to the present mesur: to be entrusted to B until her majority. [ 9 ] The teenager’s physical, intellectual and emotional development is normal. [ 10 ] She does not have any difficulties at school. She meets regularly with the school teacher of children with learning difficulties [ 11 ] She is a mature young girl for her age.
However, it is very difficult to connect with her, it is hard for X to trust people. She does not talk much. She is an anxious teenager who is vunerable in regards of her depressive symptoms. She has low self-esteem and her suicidal toughts are so strong that she try to end her life at one point. [ 12 ] She needs an environment where she receives response to all her needs and where she will be accepted for who she really is. B’s home is offering all of that. Mrs B has been implicated in X’s life for many years and they have a very strong bond. She is a key figure for the teenager.
She supports her in difficult times, helps the young girl with gaining autonomy and on her way to become a totally fulfilled adult. Mrs. B is willing to implicate herself with X until her majority and beyond. [ 13 ] The Court concludes that the security and the development of the teenager are in danger because she has behavior disturbance
and she is in serious risk of neglect. [ 14 ] The request is in its interest and should be granted.
FOR THESE REASONS, THE COURT: GRANTS the application; DECLARES that the security and the development of the teenager are in danger; ORDERS entrusting the teenager to B until her majority; ORDERS that a person working for an institution or body provides aid, counselling and assistance to the teenager and the teenager’s family for the same period; ORDERS to the mother to participate actively to the present measures, especially to receive personal help; ORDERS that the teenager receive all care and health services that she needs, especially a healthy checkup and a post-therapy follow-up for the appropriate period; ALLOWS the information’s exchange between the professional involve in the teenager and the mother situation; ENTRUSTS the situation of the teenager to the Director of Youth Protection for the execution of the present order; LOUISE GALLANT, J.C.Q.
