N o : 525-41-023230-105 DATE : 8 novembre 2011 ______________________________________________________________________ SOUS LA PRÉSIDENCE DE : L’HONORABLE JUGE LUCIE GODIN, J.C.Q. ______________________________________________________________________ Dans la situation de l'enfant : X né […] 1994 [INTERVENANTE 1] , personne autorisée par le Directeur de la protection de la jeunesse La personne déclarante -et- A -et- B Les parents mis en cause ______________________________________________________________________ JUGEMENT ______________________________________________________________________ [ 1 ] Le Tribunal est saisi d'une requête en prolongation d'une ordonnance rendue le 23 novembre 2010. dans laquelle il déclarait la sécurité et le développement de l'adolescent demeuraient compromis et ordonnait son hébergement en centre de réadaptation jusqu'au 30 juin 2011. [ 2 ] Le Tribunal autorisait alors la réintégration de l'adolescent au domicile de ses parents si la situation le permettait et ordonnait qu'aide, conseils et assistance soient apportés à l'adolescent et à sa famille pour une période d'une (1) année. [ 3 ] La requérante allègue que la situation de l'adolescent exige une prolongation d'ordonnance pour certains motifs. [ 4 ] En conséquence, elle recommande que l'adolescent soit confié à ses parents. [ 5 ] État de compromission [ 6 ] Considérant les admissions formulées par le père qui sont partagées par la mère bien qu'elle soit absente pour des raisons de travail, considérant les admissions de l'adolescent de même que la preuve documentaire et testimoniale, le Tribunal conclut que les faits allégués dans la requête ont été prouvés.
En conséquence, le Tribunal conclut que la sécurité et le développement de l'adolescent demeurent compromis pour les motifs allégués. [ 7 ] Le Tribunal retient les éléments suivants : ˛ The adolescent remained at A rehabilitation center until the end of June 2011 when he was returned home to his parents' care; ˛ The adolescent continues to struggle with his serious substance abuse problem; ˛ On November 26 th , 2010, the adolescent was taken to the emergency of the Hospital Center A after losing consciousness and vomiting blood; ˛ The adolescent had ingested a bottle of dry gin earlier during that day without the parents knowledge while on a home visit; ˛ The adolescent put himself at very high risk and had to be intubated while at the intensive care unit of the Hospital Center A;
˛ A psychiatric note from the Hospital Center A written on November 26 th , 2010, mentions that this was a very serious event and that X' addiction put him at very high risk and that he showed minimal insight into his self-destructive behaviour; ˛ The youth later on admitted that he had taken several bottles of alcohol from his parents' wine cupboard and had been drinking for the past weekends during home visits; ˛ On December 7 th , 2010, the youth tested positive for methamphetamine after having consumed ecstasy; the youth displayed highly aggressive behaviour towards other peers in the unit while under the influence of drugs; ˛ On January 4 th , 2011, the youth left the rehabilitation center in the middle of the night (2h00 am) and returned at 3 h 30 am without divulging where he had been and with whom; ˛ In February 2011, a decision was made by D r .
Balzer to take X off all prescribed medication following a disclosure that the youth had snorted his seroquel pills; ˛ In March 2011, an educator from the A Program was assigned to work with the family in view of the youth's reintegration with his parents; ˛ On June 28 th , 2011, the youth consumed marijuana at a friend's home; ˛ Since then, the youth has reconnected with Desintoxication Pavilion A to address his substance abuse; ˛ The parents continue to struggle in enforcing rules and imposing boundaries for X; ˛ The youth continues to show a pattern of abusing drugs and alcohol followed by attempts at engaging in the therapy to address his addiction. [ 8 ] Mesures [ 9 ] La mère, le père et l'adolescent consentent aux mesures recherchées par la Directrice. [ 10 ] Dans son évaluation déposée sous la cote D-2, [Intervenante 1] analyse ainsi la situation : « As a reminder, X is a vulnerable 16 year old teenager who was placed at the rehabilitation Centre on the B campus following an incident which resulted in him being hospitalized and having his stomach pumped due to the various drugs he had consumed.
Also, X was for a long period of time adamant in saying that he will continue to use Marijuana in the community and at home with his parents. X made a great improvement in his behaviour since his integration to his parents' care. He was able to work during summer and most of the time follows the house rules. X has recently re-contacted Desintoxication Pavilion A to seek assistance for his substance abuse. Despite this, he drug consumption being a longstanding problem and given that he has had patterns of relapse, the prognosis for him to stay sober is questionable.
However, X has seen C at Desintoxication Pavilion A regularly (six sessions) since his return home. Furthermore, X will be stating school shortly in a new environment; the family has just met with the new educator and the intervention is yet to start. It has been documented that X does not do well with stress. X minimizes how his lifestyle negatively impacts on his well being, puts him at risk while generating stress for his family members. There is concern that X has difficulty in maintaining sobriety for any extended period of time while in the community.
X has however shown a good ability to connect to make changes in his life style, but continued monitoring of the situation is necessary. Mr. B and Ms. A continue to be deeply concerned about their son's well being given that they have tried various resources and doctors and everyone keeps stating that they can not help X until he acknowledges his drug use. The couple have a hard time understanding why X cannot refrain using drugs. In the light of the above mentioned, X's security and development continue to remain at risk.
Therefore, it is recommended that as the current Court order expires on 2011-11-23, a return to Court will be necessary to request on going DYP involvement for a period of nine (9) months [1] . » [ 11 ] Avant de formuler ses recommandations, l'intervenante sociale précise les objectifs recherchés : ˛ For X to fully engage in addressing his drugs/alcohol addiction; ˛ For X to live in a safe and secure environment; ˛ For X to respect rules at home, at school and in the community; ˛ For Mr. B and Ms.
A to receive additional support in setting effective limits with X and to present a common front in so doing [2] . [ 12 ] Considérant l'ensemble de la preuve documentaire et testimoniale, de l'évaluation de la situation faite par l'intervenante, sociale, le Tribunal conclut que la recommandation de la Directrice est dans l'intérêt de l'adolescent. [ 13 ] Considérant la nature des difficultés de l'adolescent et du temps requis pour parvenir à atteindre ses objectifs, le Tribunal conclut qu'une période d'une (1) année est justifiée dans les circonstances.
[ 14 ] THEREFORE, THE COURT: [ 15 ] GRANTS the motion; [ 16 ] EXTENDS the decision rendered on November 23 rd , 2010; [ 17 ] DECLARES that the security and the development of the adolescent are still considered to be in danger; [ 18 ] ORDERS that X remains entrusted to his parents; [ 19 ] RECOMMENDS that X engage in individual therapy to address his unresolved issues; [ 20 ] RECOMMENDS that X address his substance abuse problem; [ 21 ] ORDERS that the adolescent refrains from consuming drugs and alcohol; [ 22 ] ORDERS that X submit to random drug testing; [ 23 ] ORDERS that X continue to collaborate with the DYP, including accepting the services of an educator; [ 24 ] ORDERS that aid, counsel and assistance be provided to the adolescent and his family for a period of one (1) year as of today; [ 25 ] ENTRUSTS the situation of X to the DYP for the execution of the present order. __________________________________ LUCIE GODIN, J.C.Q.
