[ 2 ] Le Tribunal est saisi d’une demande de la Directrice de la protection de la jeunesse visant à réviser l'ordonnance que rendait le soussigné le 20 septembre 2006, et par laquelle il confiait l'adolescente en centre de réadaptation jusqu'au 30 juin 2007, avec intégration dans une famille d'accueil pendant cette période si la situation le permettait. [ 3 ] Son placement en famille d'accueil devait se terminer le […] 2013. [ 4 ] Différentes mesures de suivi social étaient également ordonnées par le soussigné jusqu'au […] 2013, à savoir jusqu'à sa majorité. [ 5 ] La Directrice de la protection de la jeunesse allègue ce qui suit: « 3.1 in 2007, the adolescent integrated her maternal grandmother's foster family; 3.2 in 2010, the adolescent's situation deteriorated and she became disrespecful and argumentative towards her grandmother; 3.3 on June 22 nd , 2010, the maternal grandmother asked for the adolescent to be transferred to another foster family; 3.4 the adolescent was transferred to the foster family of Mrs.

C, where she remained defiant; 3.5 the adolescent felt that the foster family was rude and disrespectful; 3.6 the situation deteriorated to the point where, on November 18 th , 2010, the adolescent refused to return to the foster family; 3.7 the mother is receiving the adolescent every weekend; 3.8 the mother is not in a position where she can care for the adolescent on a full time basis; 3.9 the father remained absent for the adolescent's life; » [ 6 ] La Directrice de la protection de la jeunesse recommande la poursuite du placement en centre de réadaptation jusqu'au 10 juin 2013, avec intégration dans un appartement autonome dans les douze derniers mois de l'ordonnance si la situation le permet et ceci, avec l'autorisation de la mère. [ 7 ] Différentes mesures de suivi social sont également recommandées jusqu'à l'âge de sa majorité, soit le […] 2013. [ 8 ] La mère est absente lors de l'audience, le père aussi puisqu'il est d'adresse inconnue.

[ 9 ] L'adolescente, par la voix de son avocate, admet l'ensemble des allégations de la requête et consent aux mesures recherchées par la Directrice de la protection de la jeunesse. [ 10 ] La preuve documentaire révèle que la mère de cette adolescente de quinze ans et demie, reste impliquée dans la vie de celle- ci mais ne croit pas qu'elle soit en mesure d'assumer ses responsabilités parentales à l'égard de celle-ci. [ 11 ] Elle ajoute que l'adolescente a aussi beaucoup de travail à faire avant que cela ne se produise. [ 12 ] À cet égard, voici comment s'exprime madame [intervenante 1] dans son rapport: « X is a 15 ½ year old adolescent who is in care.

X had several changes in the past few years which have affected her greatly. X had been reintegrated into her grandmother's care however this placement with her grandmother has broken down over the summer and X has been placed in a foster home. Ms. B felt that X was disrespectful towards her and there were constant arguments in the home. X did not feel important to her grandmother and believed that she was always placed last above her other siblings. On June 22,2010, X was placed in the foster home of Ms.

C however this placement was also unsuccessful due to unresolved issues that continued to surface and it was clear that X did not feel comfortable in Ms. C's home and needed to be removed. X would like to work towards independent living in the future as she believes this is the direction that would best suit her. Ms. B continues to be involved in her granddaughter's life and visits with her regularly but is not in the position to care for her. Ms.

A remains involved in her daughter's life however she does not feel that she is ready to resume the responsibility for her daughter as she believes X has a lot of work to do with herself before this could occur. » [ 13 ] La preuve documentaire ainsi que les admissions formulées à l'égard des allégations de la requête convainquent le Tribunal que la sécurité ou le développement de l'adolescente reste toujours compromis. [ 14 ] Puisque les mesures proposées par la Directrice de la protection de la jeunesse le sont dans l'intérêt de celle-ci, le Tribunal les faits siennes. [ 15 ] POUR CES MOTIFS, LE TRIBUNAL : [ 16 ] DECLARES that the security or development of X is still compromised; [ 17 ] ORDERS that X be placed in a rehabilitation centre placement until […], 2013 , with a move into independent living in the last 12 months of the order if the situation allows and with the authorization of the mother; [ 18 ] ORDERS that the frequency and modality of contacts between X and her mother be determined by the Director of Youth Protection; [ 19 ] ORDERS that the frequency and modality of contacts between X and her father be determined by the Director of Youth Protection, and to include supervision if deemed necessary; [ 20 ] ORDERS that the Director of Youth be authorized to sign all documents/consents should the mother be unavailable to do so; [ 21 ] RECOMMENDS that X will continue to receive counselling services as deemed necessary; [ 22 ] ORDERS that aid, counsel and assistance be provided to the family until […], 2013 .
