partie défenderesse Les constructions d'Argile inc., laquelle n'a pas contesté la demande qui lui fut dûment signifiée par huissier le 27 mars 2013; [ 2 ] VU la preuve testimoniale et documentaire (P-1 à P-5) offerte par la
partie demanderesse Groupe Consultants TK inc., représenté à l'audience par Dany Huynh Le; [ 3 ] CONSIDÉRANT que la
partie demanderesse Groupe Consultants TK inc. réclame la somme de 6 615,36 $ pour les motifs ainsi énoncés à sa demande datée du 4 janvier 2013 : «1. On or around February 24,2012, following a written agreement, the Plaintiff undertook to provide the following services: Home
plans design and drafting, printing and laminating for purposes of construction permit marketing. Services provided for 3 different buildings from same contractor. 2. The agreement was signed in Greenfield Park, Quebec. 3. The services were provided between February 25, 2012 and August 20, 2012, at Greenfield Park and Beloeil, Quebec. 4. The agreement provided for the payment of an amount of $ 5,217.27. 5. The Defendant should have paid the amount owing on October 31, 2012. 6. If payment was not made within the stipulated time, the agreement did not provide for the payment of interest. 7.
The Plaintiff has not received any partial payments. 8. The Defendant still owes the Plaintiff an amount of $ 5,217.27. 9. In addition to the amount claimed above, the Plaintiff claims an amount of $1,398.09 for the following reasons: Nominal $1 per day for each of 3 unpaid artworks, total 736 days since 24/02/2012; 24/02/2012 and 16/05/2012 until today, 22/11/2012 ($736) Plus 12 hours at the rate of $40/h ($480) for pursuing this matter since last notification to the defendant plus taxes. 10. The total amount of the Plaintiff's claim is $ 6,615.36. 11.
The Plaintiff makes the following clarifications to the facts set out above: I have been trying reach the defendant numerously by phone and emails since August 2012 to remind Jonathan Lapointe, the president of the company about the lateness and even suggested payments to be made in smaller portions. No effort whatsoever from the devendant to respond to any of my messages. 12.
Although payment has been duly requested by means of a formal notice, the Defendant has refuset of failed to pay.» (sic) [ 4 ] CONSIDÉRANT que monsieur Dany Huynh Le a offert un témoignage crédible et une preuve documentaire suffisante au soutien des allégations de la demande pour la somme réclamée de 6 615,36 $ représentant le paiement d'honoraires professionnels de confection de plans, et dommages associés à l'utilisation non autorisée desdits plans; POUR CES MOTIFS, LE TRIBUNAL : [ 5 ] ACCUEILLE la demande, [ 6 ] CONDAMNE la
partie défenderesse Les constructions d'Argile inc. à payer à la
partie demanderesse Groupe Consultants TK inc. la somme de 6 615,36 $ avec intérêts au taux légal et l'indemnité additionnelle prévue à l'
