Annick Nguyen Clerk JUGEMENT [ 1 ] After having read the cross-appellant's motion, I am of the view that the ends of justice and the principle of proportionality will be better served by granting an additional delay to the cross-appellant to file her brief ending 30 days following the Supreme Court of Canada's final decision in connection with the appellant's announced intention to seek leave to appeal the dismissal of his appeal on February 25, 2011 for failure to provide the security ordered by the Court on October 6, 2010. [ 2 ] Therefore, I grant respondent/cross-appellant an additional delay to produce her brief in cross-appeal ending : (i) 30 days following the Supreme Court of Canada's final decision on appellant's motion for leave to appeal the dismissal of his appeal on February 25, 2011 for failure to provide the security ordered by the Court on October 6, 2010; or (ii) 30 days following the expiry of the period to seek leave to appeal from the judgment dismissing the appellant/cross-respondent appeal. [ 3 ] The whole without costs. [ 4 ] Furthermore, I am of the view that a case management of this file is in order considering the number of motions so far and the nature of the proceedings.

Thus I order that any new proceedings in this file be referred to me by the clerk's office for management and/or hearing. PIERRE J. DALPHOND, J.C.A.
