Section 95 Y.P.A. ______________________________________________________________________ WARNING : The Youth Protection Act, forbids the publishing or broadcasting of information allowing for a child or the child's parents to be identified.
Any person who contravenes this provision commits an offence and is liable to a fine. [sections 11.2.1 and 135 Y.P.A .] [ 1 ] Le Directeur de la protection de la jeunesse (le « Directeur ») demande au Tribunal de réviser l’ordonnance rendue le 20 mars 2015 par l’honorable Gaétan Zonato, laquelle prévoyait que les enfants, X, Y et Z, respectivement âgés de cinq (5), dix (10) et quinze (15) ans, étaient confiés en famille d’accueil jusqu’à leur majorité respective. [ 2 ] Par sa demande, le Directeur souhaite que le Tribunal confie à madame B, grand-mère maternelle et milieu d’accueil des enfants, l’exercice de certains attributs de l’autorité parentale. [ 3 ] La mère, dûment représentée, se dit en faveur de la modification recherchée par le Directeur. [ 4 ] L’enfant est dûment représenté.
Son avocat fait valoir au Tribunal son accord aux mesures recherchées par le Directeur. [ 5 ] Le Directeur a déposé au soutien de sa demande la pièce D-2 pour valoir preuve et témoignage de son auteur. CONTEXTE ET ANALYSE [ 6 ] Depuis l’ordonnance du 20 mars 2015, l’enfant continue d’évoluer positivement dans le milieu de sa grand-mère maternelle, madame B. [ 7 ] La grand-mère reçoit de l’aide ponctuelle à domicile afin de l’aider à voir à l’ensemble des besoins de l’enfant.
Elle s’occupe assidûment du suivi médical et scolaire de ce dernier. [ 8 ] La mère, de son côté, demeure impliquée dans la vie de ses enfants bien que son investissement auprès d’eux varie dans le temps.
L’enfant est parfois réticent aux contacts avec cette dernière et il demande la présence de sa grand-mère afin de le sécuriser. [ 9 ] Par ailleurs, la mère ne participe pas au suivi médical et scolaire de l’enfant. [ 10 ] Bref, la grand-mère s’occupe des besoins physiques, affectifs, intellectuels et moraux de ce dernier. [ 11 ] C’est pourquoi le Directeur demande aujourd’hui que lui soit confié l’exercice de certains attributs de l’autorité parentale, d’autant plus que la relation avec la mère des enfants peut varier dans le temps. [ 12 ] La mère reconnaît le rôle important qu’occupe la grand-mère maternelle dans la réponse aux différents besoins de son fils et se dit en faveur de lui confier ses attributs de l’autorité parentale. [ 13 ] Cette mesure est bien fondée et assure à l’enfant une continuité dans les soins de santé et une célérité dans la réponse à ses
besoins. [ 14 ] THEREFORE, THE COURT: [ 15 ] GRANTS the application; [ 16 ] DECLARES that the security and the development of the child, X , are still compromised under the Youth Protection Act ; [ 17 ] REVISES the decision rendered on March 20, 2015 by the following measures; [ 18 ] ORDERS that the child be entrusted to the foster family of Ms.
B; [ 19 ] ORDERS that the frequency and modality of contacts between the child and the mother be determined by the Director of Youth Protection, including supervision if deemed necessary; [ 20 ] WITHDRAWS from the mother the exercise of parental authority in regards to health and medical issues, education, extra- curricular activities, permission to travel and to obtain a passport and GRANTS the exercise of those parental authority to Ms.
B; [ 21 ] AUTHORISES the Director of Youth Protection to obtain and share information with any professional working with the family; [ 22 ] ORDERS a person working for [Centre A] to provide aid, counsel and assistance to the child and the family; [ 23 ] MAINTAINS all compatibles measures rendered on March 20, 2015; [ 24 ] THE WHOLE until the age of his majority ([...]-2029 ); [ 25 ] ENTRUSTS the situation of the child, X to the Director of Youth Protection A, who shall see that the measures are carried out.
