N o : 525-41-019784-073 DATE : 28 novembre 2011 ______________________________________________________________________ SOUS LA PRÉSIDENCE DE : L’HONORABLE JUGE LUCIE GODIN, J.C.Q. ______________________________________________________________________ Dans la situation de l'enfant : X née […] 1995 [INTERVENANTE 1] , personne autorisée par le Directeur de la protection de la jeunesse La personne déclarante -et- A Le parent mis en cause ______________________________________________________________________ JUGEMENT ______________________________________________________________________ [ 1 ] Le Tribunal est saisi d'une requête en révision et prolongation d'une ordonnance rendue le 21 décembre 2010, dans laquelle il ordonnait l'hébergement de l'adolescente en centre de réadaptation et autorisait son intégration dans une famille d'accueil lorsqu'une famille adéquate pour elle serait identifiée de même que certaines autres mesures visant à corriger la situation .
Le tout pour une période d'une (1) année. [ 2 ] La requérante allègue que la situation de l'adolescente exige une révision et prolongation d'ordonnance pour certains motifs, en conséquence, elle recommande la poursuite de l'hébergement de l'adolescente en centre de réadaptation jusqu'à ce qu'elle atteigne l'âge de la majorité. [ 3 ] L'adolescente est présente et accompagnée de son avocate, M e Marie-Josée Lavigueur. [ 4 ] L'adolescente par le biais de son procureur fait une admission générale de tous les faits allégués et exprime son accord avec les recommandations. [ 5 ] Cependant, M e Lavigueur a des questions en regard de la possibilité d'intégrer X dans une famille d'accueil régulière ou de répit. [ 6 ] État de compromission [ 7 ] Tenant compte de l'admission générale formulée par le procureur de l'adolescente et tenant compte de la preuve documentaire, le Tribunal conclut que la situation de l'adolescente exige une prolongation et révision de l'ordonnance pour les motifs allégués. [ 8 ] Le Tribunal retient les éléments suivants : - the adolescent remained placed in group A where she is progressing well; - although the adolescent initially displayed behavioural issues, she was able to show enough insight to positively change her behaviour; - the adolescent successfully completed her Secondary 5 but is not interested in pushing her studies further, for the moment; - the adolescent participated in receiving services from a tutor, a program A and an educator from the program B;
- the adolescent worked at the A Club as a counsellor in training and was considered a valued employee; - although a regular follow-up was made with the resource department, no foster home has been identified for the adolescent. [ 9 ] La sécurité et le développement de l'adolescente demeurent compromis pour ces motifs. [ 10 ] Mesures [ 11 ] Bien que l'adolescente consente à la poursuite de son hébergement en centre de réadaptation, et ce, pour des motifs visant à l'aider à développer son autonomie, et pour ce faire, lui permettre d'évoluer dans un milieu stable capable de contenir ses besoins émotionnels, intellectuels et physiques, l'adolescente a par ailleurs, aussi besoin de développer des liens avec l'extérieur.
Ms. [intervenante 2], a témoigné à l'effet que les Centres jeunesse sont à la recherche d'une telle ressource et que dans l'éventualité où une telle trouvaille est faite et qu'elle convient à l'adolescente, la Directrice n'a pas d'objection à ce qu'elle puisse en bénéficier. [ 12 ] Soulignons d'abord que l'adolescente a complété avec succès son secondaire 5.
C'est tout en son honneur lorsque l'on connaît les difficultés auxquelles elle a dû faire face au niveau académique. [ 13 ] Elle a fait preuve de persévérance et elle en bénéficie aujourd'hui. [ 14 ] La soussignée lui transmet ses plus sincères félicitations pour cette réussite. [ 15 ] Ms. [intervenante 2] identifie les développements suivants dans la situation de l'adolescente depuis le dernier jugement. Elle écrit : « It should be noted that this worker was assigned to the case immediately following the court hearing. The undersigned has met with X approximately every three weeks when the situation allowed.
X has remained in a reception centre specifically; program C. Three interventions plans were completed with X and in conjunction with ^program C; the last one dated August 9, 2011. Initially, program C staff reported that X's behaviour was challenging and that she provoked other residents and was disrespectful. The undersigned met with X on January 21, 2011. X was able to acknowledge her own behaviour however; during an intervention plan meeting at program C in February 2011, X agreed to begin to monitor her own behaviour and successfully made positive changes.
X is in good health and continues to be followed at the Adolescent Clinic of the hospital A having received her last follow-up in July 2011. X successfully completed Secondary 5, in the Semi-skill Work Oriented Training Program, at school X was required to complete subjects in French, Math, History, and English, as well as classes directed to everyday situations and semi-skilled trade with a work component, which allowed her to do a stage at the boys and girls club in A.
X requested the help of a tutor to help her with math and the undersigned facilitated acquiring a volunteer student from University A to work with X who also served as a program A for her. With the exception of History, X did very well. X has clearly stated that she is not interested in the services of a psychologist at this time. In February 2011, the undersigned placed a referral for the programB and X was assigned an educator, Melanie Fournier to work with her until she turns 19; the program teaches basic living skills and prepares adolescents for independent living.
In March 2011, X identified a woman from the A club who was actively recruiting X to become one of her foster children. The undersigned has contacted the resources department and that home had been officially closed and is no longer a Batshaw foster home. The undersigned followed up with the resources department on several occasions unfortunately to date no home has been identified for X. Since the end of the school year X continued to work at the A Club in A as a counsellor in training. X enjoyed working at the A club and was a valued employee.
On August 10, 2011, X attended an interview at Carrefour Jeunesse D'emploi; a specific program D. It's 16-week program, which involves working 30 hours a week. Participants are paid minimum wage and learn additional independent living skills how to complete their CV and rent apartment, apply for a job and successfully attain employment.
If accepted X will start the program at the end of August 2011 [1] .» [ 16 ] Madame [intervenante 2] note que l'adolescente maintient des contacts avec son frère via facebook et qu'ils se sont rencontrés accidentellement à trois (3) occasions. [ 17 ] Madame [intervenante 2] note : « The undersigned has attempted to arrange scheduled visits between the siblings however to no avail. X cancelled the visit with her brother as it interfered with her work at the A Club. X has reported that at this time she is not interested in setting up scheduled visits with her brother.
X has chosen to not have any contact with the C family [2] . » [ 18 ] X dans son témoignage a identifié que son frère entretient de tels contacts avec la famille Muelema. [ 19 ] Avant de formuler ses recommandations, l'intervenante sociale a identifié le but et les objectifs d'un plan d'intervention : « The goal is to ensure that X is maintained in a stable environment that assures her security and continued emotional, intellectual, and physical development; to ensure that her needs are met in terms of appropriate support and guidance towards independent living, to
encourage contact between X and her brother Y [3] .» [ 20 ] Le Tribunal comprend que la Directrice tente de trouver une famille d'accueil ou de répit pour l'adolescente ce qui dans les circonstances s'avérerait très profitable pour elle. [ 21 ] Tenant compte de l'ensemble de la situation, de la preuve documentaire et testimoniale, le Tribunal conclut que tous les faits allégués dans la requête ont été prouvés et que les recommandations de la Directrice sont dans l'intérêt de l'adolescente. [ 22 ] THEREFORE, THE COURT : [ 23 ] GRANTS the motion; [ 24 ] DECLARES that the security and the development of the adolescent continue to be in danger; [ 25 ] ORDERS that X be entrusted to a rehabilitation centre until her age of majority, witch is February 4 th , 2013; [ 26 ] ENCOURAGES contacts between X and her brother ,Y ; [ 27 ] AUTHORIZES DYP to have complete signing authority for the adolescent; [ 28 ] RECOMMENDS that DYP continue to make efforts to find respite for X; [ 29 ] ORDERS that aid, counsel and assistance be provided to X and her brother until her age of majority; [ 30 ] ENTRUSTS the situation of the adolescent to the Director of Youth Protection of Batshaw Youth and Family Centres. __________________________________ LUCIE GODIN, J.C.Q.
