Paola Garcia Rosario, Clerk at the hearing JUDGMENT [ 1 ] The applicant seeks leave to appeal from a judgment of the Superior Court that summarily dismissed his application for judicial review on the grounds, firstly, that it was unfounded in law even assuming that the facts alleged were true (article 168, para. 2 C.C.P. ) and, secondly, that it constituted an abuse of procedure (article 51 et seq. C.C.P. ). [1] * * * [ 2 ] Judgments dismissing a judicial application because of its abusive nature and judgments relating to applications for judicial review of the kind involved here may be appealed only with leave:
article 30 para. 2(3) and 2(5) C.C.P. [2] Pursuant to
article 30, para. 3 C.C.P. , leave will be granted if the applicant shows that “the matter at issue is one that should be submitted to that Court, for example because it involves a question of principle, a new issue or an issue of law that has given rise to conflicting judicial decisions/ la question en jeu en est une qui doit être soumise à la cour, notamment parce qu’il s’agit d’une question de principe, d’une question nouvelle ou d’une question de droit faisant l’objet d’une jurisprudence contradictoire ”. [ 3 ] As the Court recently underscored, additional considerations come into play when leave is sought from a judgment dismissing a judicial application because of its abusive nature: [3] [31] Dans un cas d’abus, la permission est requise parce qu’il faut éviter de laisser l’abus se perpétuer en appel.
Bien que la présence d’une question de principe, d’une question nouvelle ou d’une question de droit faisant l’objet d’une jurisprudence contradictoire puisse justifier d’accorder la permission, dans la plupart des cas d’abus, la question est plutôt de savoir s’il existe une faiblesse apparente dans le jugement rejetant l’action et la déclarant abusive, de telle manière qu’il y a un risque d’une injustice [ F.F. c.
S.K. , 2019 QCCA 1803 , para. 4] . [ 4 ] Moreover, leave to appeal from judicial review judgments is granted sparingly notably because, as Justice Kasirer emphasized shortly before his appointment to the Supreme Court of Canada, “ [e]n matière de contrôle judiciaire, la Cour n’est pas une instance d’appel qui a comme vocation la correction de toutes les erreurs commises en première instance ”. [4] * * * [ 5 ] After having carefully reviewed the record, the first-instance judge made several findings, including one to the effect that “ l’examen de l’ensemble du dossier démontre une situation d’abus évidente, une témérité du demandeur et un mépris des principes de proportionnalité du système de justice ”. [5] My own review of the record — including the applicant’s notice of appeal and application for leave to appeal, which are generally disjointed, unclear and incoherent — leads me to the conclusion that she was undoubtedly right to so conclude. [ 6 ] The proposed appeal has no reasonable chance of success.
FOR THESE REASONS, THE UNDERSIGNED: [ 7 ] DISMISSES the application for leave to appeal, with costs. FRÉDÉRIC BACHAND, J.A.
