Protection de la jeunesse — 128219 2012 QCCQ 19097 JT 1052 COURT OF QUEBEC CANADA PROVINCE OF QUEBEC DISTRICT [...] LOCALITY […] Youth Division No: 550-41-000056-091 DATE: September 25, 2012 ______________________________________________________________________ IN THE PRESENCE OF: THE HONOURABLE LOUISE TURPIN ______________________________________________________________________ In the case of: X Born on: […] 1997 ______________________________________________________________________ JUDGMENT ______________________________________________________________________ [ 1 ] Youth Director is now seeking an order to entrust X in a rehabilitation center for a four-month period and if warranted her progressive insertion at her mother's. [ 2 ] Let us recall that since December 2009, the focus was on a placement for X until her majority. [ 3 ] The objective behind this measure was to stabilize her once and for all.
Especially since she had lived many placements in the past and that her mother was not able to address her needs and offer her a secure environment. [ 4 ] As of now, the social worker is at a point where she is clinically at a halt with X.
She is of the view that it is worth to try entrusting her to her mother progressively, since X has always hoped to live with her. [ 5 ] On the other hand, [Social worker 1] still fears that Mrs A returns to her delinquent behaviour, specifying that only Mrs A's choices will determine X's stability. [ 6 ] Mrs A must acknowledge that the center A have X's best interest at heart and that her collaboration is warranted. [ 7 ] If this project is to succeed, the mother must offer an honest and transparent cooperation. [ 8 ] X lives for her mother's approval and it is time that Mrs A shows up and be a parent for her daughter. [ 9 ] Ideally, X would prefer a shorter period in rehabilitation center than the one proposed by the social worker.
But to be realistic, it will take at least the four months recommended to prepare daughter and mother to start living together.
CONSEQUENTLY THE COURT : DECLARES that the security and development of the adolescent is still compromise; GRANTS the petition; REVISES the decision rendered on the 25 th of October, 2011; ORDERS that X be entrusted to a rehabilitation center for a period of 4 months with a progressive insertion at her mother's if the situation permits it; ORDERS that the contacts between X and her mother be according to the modalities set by a person authorized by the D.Y.P.; ORDERS that the contacts between X and her legal recognized father, Mr.
B, be supervised and according to the modalities of a person authorized by the D.Y.P.; ORDERS that the contacts between X and C (biological father but not legally recognized) be according to the modalities of a person authorized by the D.Y.P. and supervised when judged necessary; ORDERS that X receives the care and services required by her situation (scholar, psychiatric, psychological follow up, attachment
disorder follow up, medical); ORDERS that the mother, Mrs A, receives help regarding the enhancement of her parenting skills and receives help to enhance the relationship with her daughter and applies the recommendations; ORDERS that X and her mother receive help to the quality of the relationship; ORDERS that Mrs A continue her personal therapeutic follow up to address her personal issues and applies the recommendations of the professionals; ORDERS that Mrs A collaborates actively with the intervention plan and the partners involved (center a CSSS, center B); ORDERS that Mrs A reports her situation, minimally once every second week, to the D.Y.P. to inform them of her current situation; ORDERS that a person authorized by the Director of the Youth Protection provides aid, counsel and assistance to X and her family for a period of 1 year; ENTRUSTS the situation of the adolescent to the Director of Youth protection who shall then see that the measures are carried out. __________________________________ LOUISE TURPIN, J.C.Q.
