Bienvenue c. Morrison 2013 QCCQ 15847 COURT OF QUEBEC Small Claims Division CANADA PROVINCE OF QUEBEC DISTRICT OF MONTREAL N° 500-32-129199-115 DATE: December 12, 2013 ______________________________________________________________________ PRESIDED BY THE HONOURABLE DAVID L. CAMERON ______________________________________________________________________ LUCIE BIENVENUE […] , Montréal, […] Plaintiff c.
KAY MORRISON […] , La Salle, […] Defendant ______________________________________________________________________ JUDGMENT RENDERED FROM THE BENCH ______________________________________________________________________ [ 1 ] Given the absence of the Plaintiff who was called on the Intercom, the Court proceeds by default. [ 2 ] This is an action arising from the sale of a car.
The allegations of the application would require some testimony, at the very least, to establish a claim. [ 3 ] In the absence, therefore, of any evidence that could support the action, the Court has no basis on which to award the damages claimed against Mr Morrison. FOR THESE REASONS THE COURT : DISMISSES the action; SENTENCES the Plaintiff to pay the Defendant’s judicial disbursement of 148 $. __________________________________ DAVID L. CAMERON, J.C.Q.
