article 495.2 C.C.P. For this sole reason, the third mis en cause asks for the
summary dismissal of the appeal. [ 2 ] The alleged default, in the circumstances, cannot justify the dismissal, at this stage, of the appeal, as the situation does not meet the requirements of
article 501, subpara. 1, C.C.P. [ 3 ] Of course, the mis en cause is not precluded from making a motion for dismissal based on
article 501, subpara. 4.1 or 5, C.C.P. The appellant should also be aware of the risk that her appeal be dismissed if her factum does not include the transcripts of the depositions and the exhibits (see: s. 65 of the Rules of the Court of Appeal of Quebec in civil matters ) [1] .
