Any person who contravenes this provision commits an offence and is liable to a fine (sections 9.2, 9.3 and 135 Y.P.A.). [ 1 ] The Director of Youth Protection (the Director) seizes court of the situation of X alleging that her security and development are endangered due to serious behavioral disturbances. [ 2 ] The parties had the opportunity to discuss and are presenting an agreement on the measures and on the facts that support the application. [ 3 ] After discussions with the lawyers and the parents, the Court is satisfied that this agreement reflects the will of the parties, respects the prescriptions of the Youth Protection Act, the adolescent’s best interest as well as her rights. [ 4 ] The Court therefore ratifies the said agreement and affords it force of law.
AND THEREFORE, THE COURT : [ 5 ] DECLARES that the security and development of the adolescent are endangered due to serious behavioral disturbances; [ 6 ] RATIFIES AND DECLARES EXECUTORY the agreement submitted by the parties and which is annexed to the present judgement; [ 7 ] ORDERS that the adolescent remain entrusted to the care of her parents;
[ 8 ] TAKES ACT of the commitment of the adolescent to respect parental authority and use calm language with her parents; [ 9 ] ORDERS the adolescent to attend school regularly and to participate in all programs offered by the Director of Youth Protection to address her behavioural issues; [ 10 ] STRONGLY RECOMMENDS that the adolescent receive services to address her personal difficulties and behavioural issues (ie.
Individual therapy); [ 11 ] STRONGLY RECOMMENDS that the adolescent follow through with the recommendations made by her treating professionals (ie. psychological assessment by psychologist Diane McLean and pedo-psychiatric evaluation); [ 12 ] STRONGLY RECOMMENDS that the family receive services to address the family dynamic and parent-child relational issues (ie Organism A – Organism B); [ 13 ] ORDERS that aid, counsel and assistance be provided to the adolescent and her parents including the services of an educator, if needed be; [ 14 ] ENTRUSTS the situation of the child to the Director of Youth Protection of the CIUSSS A who shall then see that the measures are carried out; [ 15 ] THE WHOLE for a period of one (1) year.
