English version of the decision delivered by THE COURT (Orally) [ 1 ] The appellant, Mario Charlebois, obtained leave to appeal the dismissal, by a judge of the Court of Queen’s Bench, of his motion to be added as a party to proceeding MM-0126-10. In that proceeding, the Director appointed pursuant to s. 2 of the Safer Communities and Neighbourhoods Act , S.N.B. 2009, c. S-0.5, applied for an order for the closure of premises which one of the respondents, Marcel Gagnon, was renting from the other respondent, 510839 NB Ltd.
However, the proceeding in question has run its course since the order for closure which was ultimately made is no longer in effect. [ 2 ] Therefore, the issues raised by the appeal are entirely moot, and their determination would serve no useful purpose. That being so, we dismiss the appeal with costs, which we fix at $1,000. _____________________________________ J.
