Le Tribunal reproduit le jugement rendu le 25 février 2015 en y corrigeant le paragraphe 17. [ 1 ] Le Tribunal est saisi d'une requête en vertu de l'article 38 de la
Loi sur la protection de la jeunesse. [ 2 ] X, âgé de 16 ans, pèse 180 livres. Il souffre d'un retard intellectuel important, d'autisme, d'un trouble de déficit de l'attention avec hyperactivité. Il est agressif. [ 3 ] Son comportement est devenu hors de contrôle. Il frappe ses parents.
Il a tenté d'étrangler sa mère. [ 4 ] Quant à Y, elle souffre de la situation et se réfugie régulièrement dans sa chambre, barrée, afin de se protéger des humeurs de son frère. [ 5 ] La situation dégénère au point où le placement temporaire de X en ressource spécialisée devient nécessaire. [ 6 ] Les parents ont une certaine réticence face au placement mais on ne saurait leur reprocher leurs efforts et leur bonne foi. [ 7 ] Le Directeur recommande l'hébergement dans la ressource A pour les prochains 3 mois tout en maintenant des contacts familiaux à chaque semaine. [ 8 ] Les parties consentent à l'hébergement.
Quant à Y, vu l’hébergement de son frère, un simple suivi social sera suffisant. FOR ALL THESE REASONS, THE COURT: [ 9 ] GRANTS the motion; [ 10 ] ENTRUSTS the situation of the children to the Director of Youth Protection A, who shall then see that the measures are carried out: For Y
[ 11 ] DECLARES that security and development of the child are compromised according to
section 38
c) of the Youth Protection Act ; [ 12 ] ORDERS the Director to provide aid, counsel and assistance to the child and her parents for 9 months; For X [ 13 ] DECLARES that the security and development of the child are compromised according to
section 38
f) of the Youth Protection Act ; [ 14 ] ORDERS that the child be entrusted to a rehabilitation centre; [ 15 ] TAKES NOTICE that he will live at the [centre A] for the next 3 months; [ 16 ] ORDERS that contacts between the child and his parents take place following agreement between the parties; [ 17 ] TAKES ACT that the parties agree that X be at home from Sunday morning until Tuesday morning ; [ 18 ] RECOMMENDS that he be allowed to spend Easter vacation with his family if his behaviour is under control; [ 19 ] ORDERS that the child receives appropriate therapeutic support; [ 20 ] ORDERS the parents to collaborate with the Director of Youth Protection; [ 21 ] ORDERS the Director to provide aid, counsel and assistance to the child and his parents for a period of 9 months; [ 22 ] ORDERS the execution of the judgment by any peace officer, if needed.
