JUDGMENT [ 1 ] We are unanimously of the view that the «fin de non recevoir» raised by the Appellant, while it may have a basis, is not an argument which could be raised at this late stage in the receivership process currently under the supervision of the Superior Court. [ 2 ] Consequently, the motions judge was right in granting the Respondent's motion. The motion to dismiss the appeal is therefore granted, with costs, and the appeal dismissed, with costs.
