Section 95 Y.P.A. ______________________________________________________________________ WARNING : The Youth Protection Act, forbids the publishing or broadcasting of information allowing for a child or the child's parents to be identified.

Any person who contravenes this provision commits an offence and is liable to a fine. [sections 11.2, 11.2.1 and 135 Y.P.A .] [ 1 ] Le Directeur de la protection de la jeunesse (« le Directeur ») demande au Tribunal de réviser et de prolonger l’ordonnance rendue par la soussignée le 12 juin 2017, par laquelle l’adolescent était confié à son père avec une mesure d’aide, conseil et assistance pour une durée de neuf (9) mois. [ 2 ] Par sa demande, le Directeur souhaite que l’adolescent demeure auprès de son oncle paternel, monsieur C.

Une mesure d’aide, conseil et assistance est également recherchée, et ce, pour valoir jusqu’au 6 juin 2019. [ 3 ] Conformément à l’article 76.3 de la

Loi sur la protection de la jeunesse , les parties ont déposé un projet d’entente signée le 19 septembre 2018 [1] . Les pièces D-6 à D-8 ont été déposées par le Directeur pour valoir preuve et témoignage de leurs auteurs, et ce, du consentement des parties. [ 4 ] Par le dépôt du projet d’entente, les parties reconnaissent que la sécurité et le développement de X demeurent compromis.

De manière plus spécifique, elles reconnaissent les faits suivants et s’entendent sur les mesures applicables: → CONSIDERING that X has been entrusted to the care of his uncle C since February 2018 and is doing very well in his placement; → CONSIDERING that C was recognized as an official kinship foster family; → CONSIDERING that it is in X’s interest to remain with his uncle C; → CONSIDERING that X is struggling with expressing his emotion and managing his anger; → CONSIDERING that the mother continues to struggle with drug addiction; → CONSIDERING that the mother has difficulty following through with participation in a drug rehabilitation program; → CONSIDERING that the mother has recently stopped consuming cocaine and needs ongoing support to help her maintain this sobriety; → CONSIDERING that the family has experienced recent financial hardships; → CONSIDERING that all parties agree to the continuation of the intervention and agree to collaborate with the measures.

[ 5 ] Après s’être assuré que le consentement des parties est libre et éclairé, le Tribunal a fait droit aux mesures proposées par les parties, lesquelles répondent aux besoins ainsi qu’à l’intérêt de l’adolescent.

THEREFORE, THE COURT: [ 6 ] GRANTS the Application; [ 7 ] REVISES AND EXTENDS the decision rendered on June 12, 2017; [ 8 ] DECLARES that the security and the development of the adolescent , X are still compromised under the Youth Protection Act ; AND ORDERS THE FOLLOWING MEASURES: [ 9 ] ORDERS that X be entrusted to the foster family of C; [ 10 ] STRONGLY RECOMMENDS that the mother continue her involvement in a program to address her substance use, and that she follow through with all the recommendations; [ 11 ] ORDERS that the mother undergo random drug testing, as requested by the social worker; [ 12 ] ORDERS that parents not expose the adolescent to any form of conflict or parental issues; [ 13 ] AUTHORIZES the Director of Youth Protection to share and obtain pertinent information with treating professionals and school staff; [ 14 ] ORDERS a person working for the Centre intégré universitaire de santé et de services sociaux A to provide aid, counsel and assistance to the adolescent and his family; [ 15 ] THE WHOLE until June 6, 2019; [ 16 ] ENTRUSTS the situation of the adolescent, X , to the Director of Youth Protection of the Centre intégré universitaire de santé et de services sociaux A, who shall see that the measures are carried out.
