Article 95 de la Loi sur la protection de la jeunesse ______________________________________________________________________ [ 1 ] Le tribunal confirme et motive, par le présent jugement, la décision rendue séance tenante lors de l'audience du 21 décembre 2010, conformément aux exigences de l’article 90 de la
Loi sur la protection de la jeunesse . [ 2 ] Le tribunal doit déterminer si la situation et l'intérêt de X nécessitent la prolongation de la décision rendue le 17 décembre 2009. [ 3 ] À cette date, le tribunal confie l’adolescente en centre de réadaptation et impose d’autres mesures ayant pour but de mettre fin à la situation de compromission. [ 4 ] X et ses parents ont signé un formulaire de consentement pour l’application de l’article 95 de la
Loi sur la protection de la jeunesse de façon plus rapide (D-2) et admettent la véracité des allégations de la requête : « 3.1 initially, the adolescent did not engage in treatment and ran away in January 2010 and engaged in high risk behaviour during this time;; (sic) 3.2 the adolescent did not complete the program at Center A but did complete a program with a Pavillon A (sic) counsellor; she also engaged into treatment once at Unit A; 3.3 the adolescent was fully reintegrated home to the care of her parents by June 15, 2010; 3.4 since her return home, the adolescent has continued to make progress, however, there have also been issues with some home rules, and at times with school attendance; 3.5 the family continues to require the intervention of social services to ensure that the recent gains made are solidified; ». [ 5 ] Considérant le troisième paragraphe de l’article 95 de la
Loi sur la protection de la jeunesse , la pièce D-2 peut être considérée comme l’avis requis puisqu’elle est signée par toutes les parties en date du 9 décembre 2010. [ 6 ] Le tribunal prend aussi en considération le fait que les parties reconnaissent que la sécurité et le développement de X sont toujours compromis. [ 7 ] Compte tenu de la position des parties, le tribunal estime que le consentement signé par toutes les parties doit être mis en application puisqu’il est dans l'intérêt de l'adolescente et le respect de ses droits de rendre l'ordonnance qui suit. [ 8 ] PAR CONSÉQUENT ET POUR CES MOTIFS, LE TRIBUNAL :
[ 9 ] GRANTS the motion; [ 10 ] DECLARES that the security and the development of X are still in danger; [ 11 ] ENTRUSTS X to the care of her parents; [ 12 ] ORDERS X and her parents to report periodically to the Director of Youth Protection on the measures they apply in their own regard or in their child’s regard to put an end to the situation in which the security or development of the child is in danger; [ 13 ] ORDERS X to take an active
part in the application of the measures ordered by the Court, namely to attend school regularly, be on time, and to provide a medical note in case of absences; [ 14 ] ORDERS X to take an active
part in the application of the measures ordered by the Court, namely to respect the house rules and curfew to be determined by the parents in the intervention plan with the assistance of the delegate; [ 15 ] ORDERS the parents to take an active
part in the application of the measures ordered by the Court; [ 16 ] ORDERS X and her parents to report in person at regular intervals, to the Director of Youth Protection to inform her of the current situation; [ 17 ] RECOMMENDS X to participate in counselling; [ 18 ] RECOMMENDS the family to participate in family counselling; [ 19 ] AUTHORIZES the Director of Youth Protection to obtain and share information with the professionals involved; [ 20 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to X and her family for a period of six (6) months; [ 21 ] ENTRUSTS the situation of X to the Director of Youth Protection of Youth and Family Centres A, who shall then see that the measures are carried out. __________________________________ DOMINIQUE WILHELMY, J.C.Q.
