Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). ______________________________________________________________________ [ 1 ] La Directrice de la protection de la jeunesse (la Directrice) demande au Tribunal de prolonger son ordonnance rendue le 12 juin 2018. [ 2 ] Plus spécifiquement, elle demande de confier X (17 ans) chez sa tante maternelle et qu’un suivi social soit offert à la famille jusqu’à sa majorité le [...] 2020. [ 3 ] L’adolescente, par la voix de son avocate, est en accord avec les mesures proposées. [ 4 ] La mère fait des admissions et est en accord avec les mesures proposées.
Elle veut reprendre contact avec sa fille et désire respecter son choix. [ 5 ] Le tuteur légal de l’enfant fait des admissions et est en accord avec les mesures proposées,
CONTEXTE, ANALYSE ET DÉCISION [ 6 ] La sécurité et le développement de l’adolescente sont déclarés toujours compromis le 12 juin 2018. [ 7 ] L’adolescente est depuis confiée à sa tante maternelle. [ 8 ] Somme toute, l’adolescente se développe positivement dans son milieu de vie. À l’exception de quelques événements en lien notamment avec sa consommation de stupéfiants, celle-ci a un bon comportement. [ 9 ] Elle a intégré l’école de quartier de sa tante et réussit bien. [ 10 ] La mère a d’abord coupé les contacts avec sa fille pour ensuite vouloir les reprendre.
Toutefois, l’adolescente ne veut plus, pour le moment, de contact avec elle. [ 11 ] La mère manque de sensibilité relativement à l’impact que peut avoir les coupures relationnelles sur sa fille. [ 12 ] La tante maternelle collabore positivement au suivi social.
Elle apprécie l’aide d’un éducateur et met en application les conseils offerts. [ 13 ] L’adolescente évolue positivement auprès de sa tante et désire y demeurer. [ 14 ] La tante maternelle est en accord pour s’impliquer dans la vie de sa nièce bien au-delà de sa majorité. [ 15 ] La mère refuse, pour le moment, des contacts avec la tante maternelle mais respecte le choix de sa fille.
Elle veut toutefois reprendre graduellement contact avec sa famille. [ 16 ] Le Tribunal estime que les mesures proposées sont dans le meilleur intérêt et le respect des droits de l’adolescente et au surcroît elles font l’objet de l’assentiment de tous. CONSEQUENTLY, AND FOR THESE REASONS, THE COURT: [ 17 ] GRANTS the Application; [ 18 ] DECLARES that the security and development of the adolescent continue to be endangered within the meaning of the Youth Protection Act ; AND IN VIRTUE OF THE POWERS CONFERRED UPON THE COURT BY
SECTION 91 OF THE YOUTH PROTECTION ACT: [ 19 ] ORDERS that the adolescent be entrusted to the foster home of her maternal aunt, Mrs.
C; [ 20 ] ORDERS that the adolescent continue to receive services to address her personal issues and that she follows the recommendations made by treating professionals; [ 21 ] ORDERS that the frequency and modality of contacts between the adolescent and her mother be determined by the Director of Youth Protection, including supervision as deemed necessary, taking into consideration the state of the parents and the best interest and wishes of the adolescent; [ 22 ] ORDERS that the frequency and modality of contacts between the adolescent and D be determined by the Director of Youth Protection, including supervision if deemed necessary, taking into consideration the best interest and the wishes of the adolescent; [ 23 ] ORDERS that any contact between Mr.
E and the adolescent be supervised by a person other than the mother, and ORDERS that the frequency and modality of contacts between the adolescent and Mr.
E be determined by the Director of Youth Protection, taking into account the wishes and best interest of the adolescent; [ 24 ] RECOMMENDS that the mother continue to take steps to address her personal issues and report her progress to the Director of Youth Protection; [ 25 ] AUTHORIZES the Director of Youth Protection to exchange pertinent information with treating professionals and service providers working with the family; [ 26 ] WITHDRAWS from the mother the exercise of attributes of parental authority pertaining to medical, educational, leisure activities, travel, including obtaining a passport and driver’s license and GRANTS the exercise of these attributes to Mr.
B; [ 27 ] ORDERS that aid, counsel and assistance be provided to the adolescent and her family, [ 28 ] ENTRUSTS the situation of the adolescent, X, to the Director of Youth Protection of the Centre intégré universitaire de santé et services sociaux (CIUSSS) A, who shall then see that the measures are carried out; [ 29 ] ORDERS the execution of the present judgment by any peace officer if necessary; [ 30 ] THE WHOLE until the age of majority of the adolescent, on [...], 2020.
